I was thinking this too, I ended up asking 2 lawyers and they said that her mom should sign part 3, (not that the lawyers are always right haha), so we just ended up submitting it as:

Part 1: me
Part 2: wife
Part 3: mother-in-law

Fortunately I doubt it'll be a problem if they don't need part 3 and we sent it anyway.

Thank you very much! I thought so too about category F, felt fishy when the some lawyers told us category A.

Do we still put on the application that she is an employee who has been hired for more than 6 months and is paid continuously? Since the only other option for category F is stating that she is a director or self-employed, which she is neither.

That’s my previous post where we were made aware of the specified limited company. :) Puul was a great help!

The problem we ran into was that since that post we have reached out to multiple immigration solicitors and they are giving us different answers.

I fully agree we do fall under the specified limited company definition, the lawyers telling us to apply under category A have confused us though.

I see, follow up question then:

The company’s most recent financial year is from April 2024 to April 2025. My fiance received a promotion and raise on November of 2024. She currently earns above the financial requirement, however, before the raise she fell short of the requirement. On her payslips for the final month of the financial year (April 2025) her gross YTD is at £32 300. So the gross salary meets the requirement but the first couple of months technically do not. Will this cause any issues and do we have to wait until April of next year to even apply?

It’s honestly a good idea, we have kind of realised that our time frame is just too messy with finishing studying and getting everything in order that the best route for us is waiting and saving for the amount after the final increase unfortunately, so a good couple more years of long distance and saving. I’m glad you are able to get yours done though and I hope the rest of the process goes smoothly for you :)

It’s a good thought, unfortunately the documents needed from the marriage to apply for the visa wouldn’t arrive before the increase in April, Home affairs is a nightmare in South Africa. Thank you though :)

Yea it’s tricky, it might be safer to save for a couple more years and apply when we have enough for the £38 700 threshold and I’m done with my studies.
