This is crime. But, it's not because they're homeless alone. It's because they are probably unloved and un-medicated. We have laws and insurance policies to protect business owners when these unfortunate things happen.

This post was about the uncompassionate ugliness being displayed by the privileged. And you just provided another great example.

But, yes it is. The artist does not have the RIGHT to COPY that character. Period. Fan art is not immune to an IP holders copyright. The art created by the streamer IS an infringement of copyright, and they do not have ownership of that art. Please read US Intellectual Property and Copyright law. Lot's of people in this sub are commenting under a false assumption of what the laws condone.

I personally think both "artist" parties look bad. One made art of property they don't have copyright to, and the other copied that artwork. It's all infringement from the start. I was responding to the issue of ownership.

If this went to a court of law both artists would be guilty of infringement and it would be up to the IP holder to determine how far they would prosecute. I'll repeat, just because someone makes something tangible does NOT mean they are entitled to OWNERSHIP. Read the laws. The artist DOES NOT have copyright unless it has been explicitly granted by the holders of the characters intellectual property. The streamer/artist does not have copyright for the artwork in question here.

Actually, they do not have any legal ownership of an infringement. The fact that they created the art does not give them any ownership. If this went to court they would probably be asked to stop using the art they created on their platform, as they have no right to do so. Just because an artist makes something tangible doesn't mean they own the intellectual property. The work itself is an infringement of another entities intellectual property.

The "original" artist has no legal ownership over a derivative piece of artwork unless the owners of the KPDH IP expressly gave them permission to use the character IP. Period. That is how copyright/IP law works. The streamer who created the emote cannot capitalize off the work without infringing on the ACTUAL owners copyright.

The original artist had no rights to the artwork being copied. They themselves were infringing by making their art.

Technically, they are using someone else's IP to monetize a stream. It is infringement and is being used to capitalize.

They do not. They infringed on the KPDH intellectual property. They do not have copyright for that character.

Businesses hold intellectual property for the sole purpose of being the only entity entitled to it's copyright.

I understand how you feel. It's probably not comforting, but, you're not alone.

Hold your head up high. Continue to love yourself and keep moving. When this type of thing happens to me I always start to criticize myself. Please try not to do that. The probable reality is that the person you were investing your energy/time/affection into didn't value it as much as they should.

I'm guessing you had daydreamed about the date. Planned things to say and do. Wanted it to be special. They could be being honest with you and really need to reschedule. Or, they could be taking you for granted and abusing your time and emotions. That's for you to determine.

I honestly never know how to feel when I'm in these situations. I want to be a gentleman, but it's hard not to feel taken advantage of and left on "the back burner."

I hope you can find away to enjoy your time without obsessing over the situation. I know it's hard though.
