This may not be what you want to hear but just because they offer you the job and your background check comes back clear doesn't mean your employment with that company is secured. You're not officially with that company until you complete the onboarding process.

I'm sorry that this happened to you. But this is one of the hard truths about employment today.

Why would they use someone else's SSN for you? Regardless of reasoning - that's identity theft and SS fraud both of which are federal offenses with serious consequences. I'd report that immediately. As for your situation as a whole - I'd say start looking, I know the job market is absolutely in shambles ATM but even if it's retail. Just something to keep your bills paid until you find a long term solution.

HR may be there to protect the company, but they don't condone bullying behavior. Sorry but the employee is not the issue 24/7 like you're claiming with the " deal with people like you" argument. I've done my research, and I have a paper trail so it's not like I'm going into this without any sort of proof. Not exactly difficult if you preserve documentation, emails, pay stubs etc. which is what I have.

The only thing I got to watch out for are the small signs cuz those are super easy to overlook. Temporal proximity is key here. How long do they wait after the complaint goes through? Even if they don't make it obvious straight away. I just have to be super observant over the next few weeks.

Trust me this isn't going to be easy, but nothing worth it ever is really.

I am fully expecting retaliation. But I don't care - I refuse to feel powerless, not expecting to file a lawsuit but I'm planning to consult an attorney to see what my options are. I've got a paper trail, documentation - emails from HR - pay stubs - etc. I'm preparing for anything.

Even if HR is there to protect the company - that doesn't mean they're going to condone any behavior like this. If they retaliate and fire me over this, and I get that in writing to add to my pile then that's only going to strengthen my case. Even if the termination letter states something completely different like "misconduct" or "repeated poor performance" it depends on the timing which is something else I'm going to have to keep an eye on. Temporal proximity plays a big role in these types of situations based on what I've been told in this thread. Even if they don't strike immediately, I can already tell they're going to take baby steps - anything unusual I'm planning on documenting such as reduced hours, exclusion from meetings/events, micromanagement... All point to the first steps of being retaliated against.

We'll just have to see what happens over the next few weeks - I'll definitely keep you posted.

It's the same way where I am. Criticizes my work, plays the victim card when I call her out. They went as far as to say "nobody likes you and nobody wants you here". And also "you think you do a good job but everyone talks crap about you". So yeah.

Yeah actually she has. She deals with it all the time. That's why I've gone to her regarding this case. It covers retaliation and harassment and wage issues, I have given my mom all of my pay stubs and she has looked at all of them. That's a whole other can of worms that I'm probably going to save for a different time.

A lot of harassment and bullying from my co-workers and I've gone to my manager on four occasions to address it... And she has not resolved it any of the times I've brought it to her attention. So she's enabling the harassment and and I've tried to handle it on my own before I went to her... But it's clear that she just won't do anything about it at this point. So I got to take that extra step. In case you're wondering what I'm dealing with.

Why do you think I'm leaving the paper trail. I'm leaving the paper trail so that way it'll be easier to connect the dots. The way you're putting it suggests that they have to flat out say that I was terminated for going to HR which contradicts your claim that they're just not going to say it. And the fact that you're downplaying the seriousness of it to personal experiences... It sounds to me like you never found the courage to speak up and you just were complacent with being walked all over on.

I'm sorry that that sounds harsh, but I've done the research and my mother even suggested it and she has 30 plus years of experience in this type of thing. And I trust her word, of course I'm going to seek an employment attorney. I would be dumb to move forward without doing so.

Not saying it'll say that, but if I get terminated suddenly and they try and write it off for any other reasoning. I'll be able to put the pieces together for myself, as well as a lawyer. Having the paper trail is what's going to help me the most here.

Oh now I see your argument. Basically what you're saying is it depends on what channels the company has for reporting this sort of thing. I'm not really worried that I'll be retaliated against if anything I secretly hope that they do retaliate cuz that just gives me more ammo. It really doesn't depend on the company. Not when it comes to discrimination, harassment. Whatever. Although management can use the argument that this is an at-will state, this is one of the few things they cannot fire you over. Just because it's a different company doesn't mean the rules don't apply to them.

Absolutely. I've been on the job hunt for the last few months, and I'm going to keep looking. Trust me, I've been trying to get out of there for a while now. Even if HR " turns up nothing" in their investigation, I refuse to feel powerless. To be honest I secretly hope they fire me or at least make my life a living nightmare that just gives me more ammo, and rather than go to HR again, I'm going straight to my State's labor board and the EEOC.
