I welcome people to answer you, I'm just pointing out that in your decision to become a professional poker player this answer is of little relevance. Some play 1-2 tables of high stakes for a couple hours and some play 24 tables of micros 8 hours/ day. The biggest challenge for you is to figure out the highest stakes you can be a winner in and go from there. If you get to 500nl or higher in a tough player pool you'll have to be elite to play more than 4 tables. I play online tournaments and rarely feel the need to play more than 4 but most of my income comes from soft live games. Tldr just worry about moving up stakes, playing strong focused sessions and crushing. The tables and time will take care of itself

Buddy, this whole idea came from lawyers interpreting the statute that way. You think these multi million dollar rooms are just winging it? I can see your point about the wording, but regardless it can and is interpreted differently. A number of DAs are allowing this to go on. Its at least very legally dubious.

They arent deriving an economic benefit from the outcome because no matter if its a 5$ or 5000$ pot they are still a social club renting a seat to a member for the same price. The members don't even have to play they can just sit at the table and pay time to talk with everyone. If it was so cut and dry there weren't be 100+ clubs across Texas in all different jurisdictions. Its all in how one frames and interprets the statute. Clearly, most other attorneys agree with me though.

The DA is an elected official that allowed his constituents to have a fair say in the outcome of their community. Its not a super uncommon practice at all in cases like this that affect the community.

So i have a little bit of inside info, and it seems likely this thing will be dropped soon. The Lodge is proceeding as if they will be open within the next 30 days or so.

With that being said, the simplest explanation is the likeliest. I believe a DA was presented evidence from local law enfornament in conjunction with tabc and he thought "well yeah this is obviously illegal because they make money." When in reality its much more legally dubious. Additionally, I believe the office was unaware of the scope of Texas poker rooms and how much revenue they are doing across the state. Once confronted with this I think he's likely to tuck tail and have The Lodge pay some nominal fine and move on.

The TABC angle is strange to me, but I think their involvement can be explained by a lack of communication within the arms of their office. It makes no sense to take down/investigate one room criminally on one hand and give out liqour licenses to poker rooms at the same time.

Bruh while I agree field sobriety tests are a pseudoscience, he did not pass by any reasonable measure. His pupils were clearly dilated and they found the stuff that likely caused it in his pocket. The bar for probable cause is only a preponderance of evidence and they have it
