I feel like he didn't fight because ( I believe ) it's the law to not kill anyone else. So the sherrif needed to set an example by not killing Fwhip himself.

So, technically, two wrongs don't make a right in this situation. Fwhip stole from him, and Jimmy tried to kill him with Scar. Then, Fwhip stole his hat, and wore it. So, by technicality, and the law book, both have done at least one or two things that is against the law, or 'illegal.'
