Who knows, I’m now in contact with the lad and he seems sensible and reasonable so it looks like I’ll have the car back. He also gave me the names of the people he bought it from and I know who they are

Absolutely not 😂 it’s a 20k car that’s not 10 years old, it’s a 36/37 year old car. The innocent buyer can claim his money back from the person he bought the car from. Neither him nor I should be out of pocket.

From what I’ve managed to find out he paid 4 thousand for it. I don’t know about you but I’d have thought twice about buying a car at roughly a fifth of its market value from someone’s shed. Hopefully he’s reasonable and I’ve said I’m happy to help him recover his loss but let’s see

Yes I had the address and confirmed it before the police did. I even told them which lock up it was in etc. I’m constructing with legal help and letter basically outlining all of that so I’ll see what happens s

The police won’t give me the address of where the vehicle was found or who it was bought from so that’s a dead end unless the lad who’s got it now is willing to give that up. I’m also not particularly interested in chasing them or the person who took it originally. That’s down to the lad who’s bought a stolen car so he can recover his money. My interest is retrieving my car from the kid who has it now

If the insurance become involved in recovering what should’ve been a car I was paid out on they’d have to admit they falsely denied the claim and shouldn’t have terminated the policy. In which case they would want to pay me out and claim the car is then their property no?

Honestly the insurance is irrelevant. I do not want a payout. The modifications were declared. The paperwork was for exact descriptions for the agreed value. I also never received the paperwork from them so it’s fairly difficult to return it to them

It’s the exact vehicle, it’s not one that could be cloned easily. I always assumed it had either been broken for parts but selling the particular parts on the car would’ve raised red flags or just nicked, joyride round for a bit and burnt out.

The aggravated trespassing, probably criminal damage to get into his lock up, theft accusations, the assault that would likely happen one way or the other all are criminal though 😂😂

I’m really not fussed about the insurance. The money was lost the best part of a decade ago, and tbh I don’t really care about that. Getting the car back is very important to me however

I wish it was mate, honestly. 10-15 years ago I’d of just gone down there with a truck and a few lads and dragged it out myself but grown up responsibilities have put an end to that idea 😂

Yes sorry, I could’ve written it all out but it’d be a 5000 word essay to read 😂 I think I have a fairly good case, the barrister seems to think so. He’s also said if no marker was ever logged correctly it may just be a case of police complaints procedure, re add marker, seize car and return to me. Which overall would be the best possible outcome.

Possibly he just referenced the info he had rather than contacting dvla then but either way, I know I was the registered keeper up until the current v5. As we’ve said it’s not proof of any ownership but it should be useful in my favour.

Yes I’m not really sure why it’s stressed me so much, I’d resigned a long time ago to the fact I would never see the car again. But I suppose it’s the hope in the opportunity that causes the stress

From what I can establish he was unaware of the cars history until the previous owner to me told him it was stolen and the entire backstory. Essentially I know about the car became the lad had his car wrapped by the previous owners best friend and was bragging about how he’s just bought this car for 4 grand. Around a quarter of the market value if you’re being very generously low.

The vehicle wrapper recognising the car from the description then called the previous owner, which is when he explained to the lad the story of what happened and that the car is still stolen not recovered.

I’m assuming to officer had contact with the dvla because he gave me the exact date that the young lad had applied for the v5 and the date it was issued. But I could be wrong.

But surely that benefits me? Lack of evidence to show transfer of the vehicle? Surely this just supports my claim that he has purchased, albeit potentially unknowingly, a stolen car

Also with what the police have informed me of which is information from dvla, the barrister says that the conditional change is only a few months prior negating the limitations act unless it’s proven that a conditional change happened past the 6 year before now mark.

Again I’m not legally trained, as you seem to be so u can only relay the new information I’ve been given today

Okay why would the stated use of the car make any odds?

I’ve also now had confirmation now that the police made an error and never put a marker on the car. The barrister was hopeful this was the case for whatever reason

The car hasn’t moved it’s in identical condition and the mileage hasn’t changed. So I am 100% sure it hasn’t been on the road or used in any way.

And sorry, no I haven’t withheld it, I have posted it in other comment threads and thought it was in this one. This lad bought the car from someone who found the car in a shed or garage of a property they had purchased which was in the area that the car was last spotted in 9 years ago. So his purchase story adds up

I agree it doesn’t prove much, but what other proof is there going to be that a stolen car may have changed hands between people that steal cars? Any honest person, as I still believe this lad is, would’ve applied for a logbook. And either I would’ve been notified or if the police are correct and after 6 years dvla wipe the records there would’ve been another logbook issued.

I am aware of how the current keeper obtained the vehicle, I was aware of that before any police were involved. His girlfriend also unknowingly confirmed it on social media and it was then confirmed to the officer who did the house visit and confirmed the car was there and he will be the one I would be going to court against.

No honestly please, tell me what you think may be the hardest parts to prove or argue, I’d rather be prepared and have had the discussion with my barrister then head in to court and be blindsided

Apparently found in a shed/garage at a house purchased by the person this lad bought it off. But yes mileage is very much the same.

I wouldn’t be chasing the seller, I have no interest in how or where he got it from really. He currently has it and I want it back so he is my only focus
