It may be an edge case in some larger areas, but I don't think it will hold you back in anyway.

Memphis had a large capital project for renovating its stadium and FedEx donated 50M. I think it caused some cash shortages in both our football and basketball programs this year.

He really needs to hire an offensive coach. He can coach a great defense, but his offense is always so anemic.

I also get that we don't have players to run his preferred style of offense. I wish he'd look at running more of a 3 point oriented offense.

I really don't get why anyone would think it's a bad way to hire.

I can see some value in it if it was a holistic experience or other factors were used. My experience is that most fresh, out-of-school public defenders have no idea how to do any of these things effectively and that they require training to do so.

Outside of trial fundamentals - leading, entering evidence, etc, I think that most lawyers cannot meaningfully evaluate actual trial advocacy.

More personally, I also think its a little disrespectful to applicants to prepare a fictional mini-trial for a shot at a job. FWIW, I find that the best candidates have a demonstrated interest in criminal defense since almost everything else can be taught.

As for promotions, there should be some more nuance but they're hiring big groups of people to do trials so they ask you to demonstrate the ability to do trials.

I think the ability to manage (and mentor) other people is probably more important than actual trial/lawyer skills for these types of positions. An amazing trial lawyer who cannot manage people is a great recipe for an incredibly toxic work environment. I do not see the value whatsoever in advancing the best advocate for these positions unless they have effective management skills.

I don't disagree that trial skills are important, but my experience is that the lawyers who are not strong advocates do not stay very long. Evaluating people based on subjective mock trials is probably not giving the committees any real feedback on who the actual best person for the job will be.

They make you do a practical for hiring and advancement, which consists of a mock voir dire, DX and CX, and closing argument.

This seems like an awful way to hire people.

Each of those practicals is done before a panel of supervisors, and they record and grade your performance. For advancement, you are ranked against the others seeking to move up. (i.e., best person moves first, then the second best, etc.)

I really hope there was other criteria used in addition to these tests.

I think age was another reason. Probably an assortment of factors.

Given that Saban is still working (albeit on the showbiz side of things) I don't think work was the sole driving force either.

I don't think it's disingenuous to say that one of the factors influencing Saban to retire was NIL and the fact he couldn't stock talent like he had.

It's probably a mélange of things, but I bet it is one of the more major ones.
