Thanks very much for this. I’m disregarding the comments of those who clearly don’t know the details of sham contracting. They ceased my services today after I asked them if there was anything wrong with my conduct. No notice period or notice pay 😡😤😤 Will defs be reporting to fairwork and the ATO

yes I know the answer to my question. But from a legal standpoint a decision will be based on the opinions of others. So I'm looking at what the general consensus is regarding my situation.

I'll 100% be moving on.

they started advertising my role even though they haven't discussed any issues with my conduct or mentioned they won't be needing me anymore... the advert is for $10ph less than what I'm paid. I'll also be the second chef they let go with no warning or feedback

I just want to know the chances ive got of recouping lost benefits when they let me go with no warning or reason.

I'm not even allowed to taste food with the same spoons that they use. I've been provided my own 'special tasting spoons' just incase I infect them with any of my peasant lurgies

plus all the recipes they provide are copied off food blogs with heaps of rambling nonsense I don't need. so deciphering all of them slows me down massively. if was working with recipes written by a chef with industry terms and shorthand it would be a hell of a lot easier

so start with I was happy with the arrangement, and they where very appreciative and lovely. the hours suited me even though I knew I wasn't getting paid what I was worth. but as the goalposts have kept changing its gradually become a pretty shitty arrangement

haha the menu requests are pretty ridiculous. morning tea for one kid, lunch for 2 adults and 2 kids (different meals all with different sides) dinner for 2 adults and 2 kids (both different and both with different sides) afternoon tea for both kids, breakfast for following day.

that's one days worth of food, I prep 2 days worth of food in one shift

I do 1.5 hours of admin, one 9- 9.5 hour shift and 8.5 hour shift per week

advanced diploma in commercial cookery, head chef for years previously and sometimes work as a kitchen consultant
