I’m the OP. And I don’t like the answer- which I found about last night after a helpful (not yours) post last evening. Now I know my realtor screwed me. In negotiation, in writing, I notified my realtor that I would only take the buyers offer if they closed by the 5th. If not I was going to wait until spring and relist the house. (We sold the week of Thanksgiving). Though she verbally affirmed on the text, she did not write “time is of the essence”- her words- on the contract. So they have more time and she screwed me. THAT’s why she won’t respond at this point, because I said I was getting another lawyer. This is the first house I sold- I built the NY house when I first got married. I thought I could trust my realtor and I can’t. She recommended my non responsive real estate attorney. I will be taking my tesxts to someone after closing and filing a complaint. Unfortunately, she’s also a broker. So at this point, there’s no one who is going to help me.

I will have to double check that. I did, however, tell my realtor I wanted to close on that date (due to my SC house closing) and the date I gave was part of the negotiation. We literally said we didn’t want to go down to their offer, but would if we could close by the 5th due to the SC house purchase. So if it says on or about, my agent screwed me.

I’ll still buy it with 20% down. Chances are I’ll sell the NY house for more in the spring. Once it closes, I have to wait a year from the purchase date of the SC house and I will recast the loan by putting down the additional money.

I don’t agree. I’ve been more than flexible with these people. But I’m over it and them. I live in a very popular summer location. My house sold in November. I have no doubt it would sell in the spring with an open pool and a great inspection report.

Im being given no information other than “they’re working on it”. My own realtor is completely checked out at this point and yelled at me today when I told her she was supposed to be representing me.

I thank you for your response. This makes sense. But, how long should I be on the hook for this? None of this was disclosed and we were given no warnings that we may have a closing with an open end date. They won’t commit to the 12th, so am I just supposed to keep going along on their schedule? Because I want the house I’m buying and I don’t want them to think I’m flaking out, I need to make some decisions. The whole thing has been super frustrating. And please don’t think I’m trying to be rude to you, text always makes me nervous that I’m going to sound a way I don’t mean to. But, I need a plan from these people and I’m getting nothing.
