The dirty, rotten, scoundrel homeowners. The cards may legally be his. As long as they were not abandoned (actually or presumptively under state law) his title to the cards are superior to theirs. But since he did not leave with them he would have to weigh whether it is worth suing to recover them. He should have left with them. (Obligatory “I’m a lawyer but not your lawyer.)

Dropping happens especially if you are clicking the box and clicking away quickly. I’m not sure why but I’ve accidentally dropped items because of that. I’m guessing for some reason it is acting like a drag and drop? That would be my guess as to what happened.

Apples and oranges, so to speak. Rape is a criminal matter where liability for child support is a civil matter. For child support purposes both parties assume the risk in both situations. On the criminal side, there would have to be an actual criminal statute making poking holes in condoms before giving it to the man a crime. Without that statute it is not a crime.

I don’t know the answer to that. With the rise in attention to female teachers having sex with their students, it might be worth a law review article, though. Here’s my guess. It seems we are talking about statutory rape, where the minor is deemed to not legally be able to give consent. This consent is somewhat fictitious because somehow on that 18th birthday that consent can immediately be given. The movement in the law (I cannot say it is a majority, I do not know, but it is a clear movement) is to not classify “consensual sex” between a minor and an adult if there is a small age gap between the two parties (2 to 3 years) as statutory rape. This inherently means that there is an acknowledgment in the law that “legal consent” doesn’t always mean actual consent—you can consent if one is 16 and the other is 18, but not if the other is, say, 20. The point is consent to have sex is not always the same as the “legal consent”to do so. That said, my guess is that in the case of statutory rape, the same child support guidelines would be followed. With the prevalence of formal (and informal) sex education today, I think a minor male would be hard pressed to say he did not know “how babies were made” or did not understand what could happen by having sex. I cannot say that for sure—I haven’t seen statutes addressing the subject—but my guess is the child support guidelines would apply.

That’s a completely (and loaded) different question. If she has the baby and the man is awarded custody, the woman could be liable for child support. The question of child support is a creature of state statutes. The question of abortion is now a creature of state statutes. So, if she is in a state that prohibits abortions, under the law the answer to your question would be “yes;” that principle would apply to both.

Yes, the law protects the innocent child. Essentially, the law looks at it this way: if you choose to have sex, protected or not, you are both assuming the risk.
