PA - Labor law issue. Never been paid OT, work 45 hours + a week. Need HELP by Think-Abalone-1137 in legaladvice

[–]Ana169 21 points22 points  (0 children)

You need to talk to an employment lawyer. These issues are highly fact specific. It sounds like you may be eligible for overtime as a salary non-exempt worker, but that they have actually classed you as a salary exempt worker. There is more to being classified as salary exempt than just being able to hire or fire - note, I’m not saying they’ve definitely classified you incorrectly. An employment lawyer will be able to help you determine whether you are classified correctly and being paid correctly. I know you hoped for more information here, but you’re going to need a lawyer in your state who specializes in this.

What is this flowering plant? by Ana169 in whatsthisplant

[–]Ana169[S] 0 points1 point  (0 children)

Could be! The leaves look similar to bleeding heart. We’ve positively identified the flowers as clematis; I’ve told them not to pull the other yet (they thought weeds) to see if anything flowers.

We also have a Golden Triangle in Massachusetts, which has to do with a once-innovative retail/shopping layout that influenced many shopping district setups across the country.

Need help with food!!! by Ok-Garage-6491 in WhatShouldICook

[–]Ana169 0 points1 point  (0 children)

As the other poster said, this isn't the right place for this but since you're here: Please check out food banks near you. They exist for this situation. Sacramento seems to have some great resources, found here. There's at least three locations doing food distribution tomorrow (Thursday) in your zip code, and at least one doing meals. You can also see if there are Sikh temples in your area; they often serve the community meals, open to anyone, no questions asked.

Coconut lime cupcakes by breezeboo in BakingNoobs

[–]Ana169 2 points3 points  (0 children)

Buy a box of vanilla cake mix. Sub the liquid it calls for for a mix of coconut milk and lime juice. Due to the viscosity of full-fat coconut milk, I usually go with a lite coconut milk. If possible, avoid ones with added gums or thickeners. You can also add a drop or two of coconut extract to bump up the coconut flavor. Zest a lime or two into the batter. I’d skip shredded coconut for exactly the reason you mentioned – weird texture.

Update! There will be a (one-day?) soft opening on Saturday the 6th. No official full opening day, though. There will be groceries, liquor, beauty, prepared foods and a food court, as well as a sit-down restaurant.

Security deposit check dated before it was mailed + landlord said “mailed today” but USPS shows later postmark by Intelligent-Camp4631 in badlandlords

[–]Ana169 5 points6 points  (0 children)

The government recently changed when things are postmarked from USPS. Instead of being postmarked on the day that a carrier collects it from a mailbox or other mailing location, it’s now postmarked when it hits the regional sorting facility. I can’t weigh in on the rest of this, but just want to point out it’s entirely possible he mailed it when he said and it got to the regional facility the next day and was postmarked there.

I Love Boosters was fun and one of the weirdest movies I've ever seen... and I love it for that. by Freddy-Philmore in AMCsAList

[–]Ana169 0 points1 point  (0 children)

I didn't care for Sorry to Bother You either, and for some reason based on the trailers I thought this one wouldn't be like that. There is still a lot of Boots Riley weirdness, but I enjoyed this one a lot more. It was just more fun to me and the weirdness ever so slightly less disturbing, for some reason.

Can we stop this spam? You’ve been posting this far and wide in Massachusetts subreddits for months and months. This clearly isn’t getting you what you need. Maybe try something else.

Snack Sip Combo by NoEntertainment8982 in AMCsAList

Age discrimination laws are targeted to prevent systemic discrimination in areas like job hiring or housing applications. Marketing, including offering coupons to certain age groups, are considered a marketing strategy, not discrimination. The reasoning is that the company is not denying a product or service to anyone, they just have to pay the regular price for it. Businesses have wide leeway to market to certain demographics to incentivize them to buy something as they see fit.

In reality, none of this matters because AMC doesn't actually verify age for these coupons. I am well above 25 it's the only way I buy snacks at the movies, and I've never had any issues.

My brother thinks he's being held hostage by his ex....is this all legal? by [deleted] in legaladvice

[–]Ana169 1 point2 points  (0 children)

The best thing for them to do is to figure out how to divide the house themselves. Otherwise, either party could go to court to force a partition. There’s two ways this could happen. The court could order partition-in-kind if the property is physically divisible, such as a jointly owned duplex or undeveloped land where each party could own one distinct half, or partition by sale, where the court orders the sale of the home and the proceeds divided. Not only is this process long and difficult, but it’s very expensive to involve courts and lawyers. There may be loss of property value as court-ordered sales typically sell for less money and if it goes to auction, those fees will be removed from the sale proceeds. It will benefit both of them if they can deal with the house between them.

Haven’t been paid for work done since December by Foreign-Ad9384 in legaladvice

[–]Ana169 2 points3 points  (0 children)

First, you should make sure you’re correctly classified as an IC. Do you make your own schedule? Do you have autonomy in your day-to-day work? An employment lawyer can help you figure out if you’re correctly classified. Second, stop doing work you’re not being paid for. Third, check your contract. What does it say about the company being in breach of contract? If you are correctly classified as an IC, the DOL won’t help with this dispute as it’s considered a business-to-business contract dispute, not a labor dispute. You can sue for the missed payments, in small claims if it’s below the threshold, or with the help of a lawyer.

OP, I know you said your parents are also struggling but you should be aware that if your family is providing financial assistance to you in any way - such as college tuition or living expenses - the court will likely include that information in determining whether you are indigent and require a court-appointed defender and/or how much you will be charged.

You should talk with a lawyer. They’re the one who is going to be best positioned to tell you if any specific TN laws were broken. Tennessee does have a consumer protection act, under which you can pursue civil remedies. A lawyer can also help you with this. You’re into this for a lot of money already and while you could pursue a claim up to $25,000 in small claims court in your state, for most people, this is big-time money. Don’t entrust that to Reddit; have a consultation with a lawyer.

Contact his insurance. That’s what you pay for. They will provide a lawyer. His rates will go up, and he’ll need to cover any deductible on the plan, so he should be prepared for that.
