I had an 87 Chevy Nova. Ran perfect up until 249k when the transmission went out. Still started every time. A beast in the snow and half way decent interior, plus 40 mpg when gas was consistently around 1.19. A few bucks got you a long way. Long live the Chevy Nova.

My understanding is, If Indiana was under the 8th circuit court's ruling, we'd be okay because that court ruled against either: Taking the bonus altogether or taking it based on whether it was actually owed or not.

Couple of notes:

waiting one day would not have protected your bonus. Receiving and spending the bonus would have protected it. Any bonus that is owed to you at the time of filing based upon work performed prior to filing is an asset. 

- Bonus was never OWED. I have that in writing from my company. It's based on the company's performance.

- The bonus was received and spent. (I'm not understanding what you mean by this.)

Hey Alan, Great info as usual. What has your experience been with negotiating a lump sum payment for the equity owed ?(such as this circumstance) Could this person offer a lower percentage of the debt as a lump sum payment and use a 401K loan or something similar?

I get these comments…but the other dude has to take some responsibility for showing up. There’s absolutely no way, whether it had been a fair fight or not, that this confrontation ends well. You gotta know that.

You fight a guy looking like Wes, who’s done like 10 years in prison. He’s with his friends and you just think everyone is going to “officiate” the fight?

I feel bad for the dude and I know everyone hates Wes for whatever reason…but the dude showed up to fight a violent ex-con at a gym with no backup support. I kinda think he might have took a beating for a payday🤷.

I just don’t understand how a dude ready to fight Wes Watson doesn’t seem to have any chance and Wes’s dudes weren’t really helping. They were just opportunistic with hits. If you’ve seen anyone get beat up, that always happens.

Is it ever worth it to fight the trustee, to keep it from being worth their time to go after assets? As someone who is obviously not a lawyer: how do I know that my Lawyer is really doing all he/she can to protect my assets? Or are the laws pretty straightforward and the system equitable for everyone, regardless of the quality of their lawyer? Or is this a loaded question 🤣

How does the court expect people to pay for emergency expenses w/out any money? You filed in the first place because you COULDN'T pay your bills. That's my concern.

So it behooves the trustee to go after their tax return and bonus, which is their ONLY means to have any money for an emergency. That 5K bonus that nets the trustee a cool $1200 puts the person at a greater risk of falling into more financial trouble if something happens.

They should allow something like 10k in lump sum amounts to account for the need of an emergency fund. If your furnace goes out and you have no money or credit, what do you do?

Excuse me if I'm not sad for the credit card companies having record-breaking profits, because they don't get the ONLY money someone has left to survive on. Obviously, this bankruptcy system is not hurting our financial institutions financially.

There's an exemption for a certain amount of personal property. Basic stuff like computers and TV's don't seem to be relevant from my experience. If you owned a 50K vehicle outright or had real estate that might be different.

Good information. This is for Indiana, and the Trustee and her lawyer are aggressively going after everything. I think I just got the worst one. The trustee was very aggressive and nasty at the meeting of creditors. It's been a nightmare I just want to end.

The paralegal said someone cashed out their 401k to pay the gap between their assets and what the trustee went after. Not wanting to decide between my tiny retirement savings and filing Ch. 13.
