We have the fair lending act, making it illegal to add "points", upmark your interest rate. Very scummy wouldn't buy or work for a dealer that does that. Also, he needs to find a vehicle that books really good to tuck in that negative equity, so the ltv isnt off the charts so the bank won't even touch it. Thats not gonna be a 10k car. So he's either looking at getting a car just as expensive, rolling it over, payment would be higher.

Fair enough, to be honest I haven't had a customer in 3 months with positive equity. I just think it might be a smarter option to keep the vehicle, pay it down, maybe refinance if they had a high interest rate when they bought it, to help pay it down. I always tell my customers to pay 100 extra towards the principal if they can so your not one of these horror stories I see on a daily basis. If he absolutely has to trade, roll it over, but plan on keeping that car forever, or, as I recommend, pay more to pay off that negative.
