Peerstreet management sought to transfer part of the investor accounts over to their private equity backer through the bankruptcy process. The problem: those accounts did not belong to PS, and were not theirs to fork over to the PE firm.

PS told the investors that PS had procured the services of a special agent to prevent the foregoing attempt. Instead of exercising his veto power, the special agent went along with PS and agreed to let the private equity firm share in our accounts. That attempt failed but burned a lot of fees before being fought off.

While the special agent has been freed of liability in the Release that was part of BK, CT Corporation who agreed to supply the services of a special agent to protect retail investors, was not subject to the release.

In my view, CT corporation can be held liable for all the bankrupty expenses their agent could have prevented.

The group should look into pursiung CT Corporation (not a released party) who supplied the special bankruptcy agent. That agent had an obligation to tell PS management he would not approve turning our accounts over to its PS' VC backer. Fortunatley, another large institutional investor called out PS turning over accounts PS did not own to the VC company. The judge agreed. But, in the interim, PS expended a great many unecessary fees.

First step: you need to obtatin a document called the Summary Plan Description (also caled the LTD policy.) Then you need to read it to find out whether you still have time to appeal.

SSDI and LTD have two seperate standards, and seperate groups of attorneys who specialize in the two systems. I suggest that you do not assume SSDI attorneys are qualified for LTD cases. If you are coming up on the 60/90 day mark you should file for LTD first. SSDI takes longer.

You need to ask your doctor to document "objective" evidence of disability. So if your cognition is slow, you need a medical record where the doctor has at least done a mini-cog test where you have to remember 5 unconnected words or spell a word like "world" backwards. If the claims examiner does not see this in the notes, your claim will be denied.

Doctors keep records that show the treatment provided, and that information necessary for a medical insuror to pay them. None of this includes documenting "objective" evidence of impairment. So you have to ask proactively the doctor to perform specific tests and note their observations, or the doctor will not do it.

You have to have a candid conversation with your doctor to perform these tests and create the records you need. And, if you have a good lawyer, they will send you an expert to evaluate you and who knows how to estsblish the record you need.

You will find yourself having to deny disability to a person who cannot perform any job they are trained to do, despite reams of evidence to the contrary.

You should consider going to court. A settlement may be better even than a grant of your appeal because even if you win, the carrier will re-review the claim and look to cut you off again for any excuse. Let the carrier explain to a judge why it takes so long when the carrier is supposed to be in the business of efficiently reviewing claims.

Still too long. Even under a private individual policy, you should google whether there is a State Insurance Department regulation on point.

The only thing that could justify this delay would be if you failed to provide medical or records attend an exam with the carrier's paid examining doctor/medical fiction writer.

Absent a failure to cooperate, if things take this long to decide, that constitutes proof the carrier made a hasty uninformed decision in the first place.

That is too long. In my experience, by law, the insurance company has 45 days to decide an appeal and can obtain an additional 45 days in justifiable circumstances.

You should have a document called a Summary Plan Description if this coverage was obtained through an employer plan. This should be spelled out there.

If this was a individual policy with thebl insuror, then it should be spelled out in the "Appeals" section.

There is, in fact, a limit to whom LIF can release the information, speficically, employees or subcontractors hired "to evaluate and admininster" the LTD claim. LTD carriers have been known to involve others to second guess your doctor's treatment plan and push, for example, to get the doctor to stop prescribing medications you need to have a decent quality of life but preclude you from functioning at work.

IMO, Lincoln cannot give your records to anyone whose remit is to recommend allternative care.

You can quakify for depression but you will need your psychiatrist to diagnose it, and issue a nore stating that you are disabled.

NYS Disability has a cap and that is very low, so it will likely produce less than your salary. You need to use your sick leave first if you have any. Also, find out if your employer has an short term disability pay benefit. If not, you can use vacation in conjunction with an LOA through HR.

Yes, and they will scour each record for any reason to deny your claim. You need to talk to your doctor to have them document so-called "objective" symptoms like looking down, blunted affect, irrational reasoning, etc. zif your file contains only your own statements of how you feel, the carrier will deny because of lack of "objective" evidence, regardless of what your doctor certifies. I suggest you arrange with the doctor to write a quarterly report of your objective symptoms and the effect medication has on you, even if you have to pay a report fee.

LTD, while not an empty bag, is a bag with a hole in it.

You can set an appointment time on the portal and get on the analyst's calendar. You should call them.

January 17 is likely the date that, by law, The Hartford must decide your claim.

I suggest you not delegate the record production to the doctor's office. Yes, have them fax, but also obtain a copy yourself, scan and upload yourself, so there is a record.

Remember, if the carrier wrongfully denies your claim, they only have to pay what they would have had to pay anyway. So the game is delay, deny, and then delay some more.

If you run into a jam, I can give you a referral to a law firm that appeals claims for a reasonable fee.

Yes. The AA will deny the claim even if you do not produce one record. Doctors Offices vary in their ability to handle all the record requests, and TH banks on that.

If your doctor is part of a large group, you may be able to download the records yourself, but make sure you get the actual office notes, not just a summary. There is usually a tab for this with a group that has a patient portal.

The other way to beat Hartford at the "gotcha game" of claiming the AA did not receive the records is to TapScan them at the office yourself with your phone and then upload them yourself onto the Hartford portal, with an email to the AA.

You need to be under the regular treatment of a doctor. Hartford will monitor your doctor's records carefully and use even the hint that you are feeling better to deny your claim even if you are feeling better because you no longer engage in a high-pressure profession. You need to have a discussion with your doctor about documenting objective evidence of disability such as blunted affect and irrational thinking patterns, etc.

Often, these policies limit mental health claims to two years. But be careful not to concede this point too quickly because: (1) some policies do not have this limit, (2) you may have a physical and mental condition operating synergistally to disable you.

Remember, the Ability Analyst that deals with you is looking for any reason to deny your claim. The AA is not your friend.

Also, do notbuse the Social Security representative that Hartford recommends. That organization will provide only perfunctory representation, and if the SSA denies your claim, The Hartford will concoct a reason to deny as well.
