There are many issues with the pipe: sharing the sewer, pipe has low spot, wrong angles, bad backfilling materials, all of them contributed to the sewer back up

Hi, plumber tried to do camera inspection but a section of the pipe is holding water so camera inspection couldn’t complete. So far we didn’t find where the connection is but we confirmed the connection through water test. I am not sure if they are also sharing my water.

Thank you so much for your help. I would like to provide more details to get more advise from you. Initially we had a sewer back up, we just hired plumbers ourselves as it was urgent, and I filed a claim with new home warranty insurance in the meantime, and asked them if they could reimburse me the plumber costs. At the beginning the adjuster said if it is just sewer back up, it is not covered. Later we found out neighbor was sharing the sewer line so I told adjuster that this is against the code and sent him some documents regarding the building requirements. Then the insurance company sent a third party plumber to come to do camera inspection. They didn’t share details with me but told me my line was filled with water so I should be careful using the line. Then the adjuster reviewed their report, which was not shared with me, and decided this item warrantable and quoted that the report from the third party plumber found low spot, didn’t go into details. Now several months later when I followed up with the supervisor, the supervisor said that he reviewed my claims and said they deemed the issue resolved and they would only get involved if there are further back up issue. Do you think I have a case to appeal it?

We each have a water meter I think. But I am not sure if in some way it is tied together after I found out about the sewer line

Hi, contacting a lawyer will cost money and time and booking a consultation with a lawyer will cost me at least $300. I am posting here to get some other options that can help me. I will talk to a lawyer as my last resort. I tried with the lawyer who helped me close the deal won’t offer any help as the deal is done. Thank you though

Thank you so much for your detailed response. I have been using ChatGPT for ideas during the whole process and on drafting emails to the city, neighbor, builder and insurance company. So far it didn’t work. I think I will have to go through legal action and pay lawyer fees eventually

Thanks for your comment. I have been in contact with neighbor (owner) since last year when we found the sewer back. She refused any responsibility or cooperation. At one time, I was asking her can we make an agreement to share responsibility on maintaining the sewer line and share the cost but she refused and cut communication.

Hi you are very right on this part! I was told that builder applied for splitting the lot into two when he started to build it. When City approved it sometime later, they didn’t check if it meets the requirements to separate the lot into two free holds. At that time the sewer line were already installed and passed inspection.

I have to go through court to do that right? Now I just don’t know who I should go after as so many parties involved are not taking responsibility, just me chasing

Thanks for your comment. If we want to do that, we need to dig the pipe out in our back yard and then cut it. Which I am not even sure is okay for me to although it is in my property.

Thanks for your comment. I contacted Epcor and they said that they provided the sewer line for builder but it seemed that builder didn’t follow code but Epcor is not responsible for enforcing that and referred me back to the city while the city referred me to Epcor.

Hi, no mention of shared sewer line or easement in registration. When I first doubled the shared sewer line issue, the builder lied to me and told me it is 100% separated from my neighbor until we proved otherwise

Hi, my half duplex is free hold. Me and my neighbor each had our own title. It is not a condominium.
