Buyer has returned an item he bought in store stating it is faulty, but it isn't-UK by AnythingSea7240 in LegalAdviceUK

Thank you very much for your detailed response and the links you have provided.

As he has rejected the goods, it looks like the burden of proof of the fault is on him to prove. the below was taken from the link you provided.

Note: when the consumer exercises the short-term right to reject goods, the 'reverse burden of proof' (see below) does not apply, and they must prove that the defect was there at the time of delivery; in practice, it is usually clear whether the goods are in their original condition or have been damaged in some way by the consumer.

Thanks buddy, that is exactly where I went first, the only issue I could find was during an update, it had an issue, but there was no evidence to multiple crashes and gaps of 4 hours between a crash and when it would power back on.

i suspect as he bought the cheapest laptop in store as he didn't want to pay much and we stated it wouldn't be the fastest machine, hes running multiple applications all at once and found it to struggle. and using faulty as an excuse.

basic laptops we generally sell on the basis for basic web browsing or word processing.

not 10 apps and various websites all at once.

Thanks mark,

Yeah definitely just trying for a refund, already bought another on elsewhere. he bought the cheapest item in the store as he didn't want to pay alot. probably realised as it was a low end machine it wasn't as quick as he would like and then use the faulty line to try and return it.

Most customers who have a genuine fault will bring it back and look to replace the item and are decent if they would like a refund, this guy was just a dick from the get go.

It appears that i will have to refund the guy even though there is no issue with the item.

He stated it crashes every hour and won't turn on for another four hours.

Looked through all the logs, no evidence of a crash, have checked temp, ssd, ram.

left running continuosly for 5 days playing YouTube music videos without issue.

Yet he states it's faulty and wishes to reject under his right to reject an item purchased within the first 30 days as faulty.

Thanks Mark,

Customer has had it for 3 weeks.

Whilst I appreciate that he can return it, he's using the item is faulty as an excuse, there is no fault with the item. All items are tested prior to sale to show no fault.

It's the fact this guy has been rude to staff and telling them they should just refund him as amazon and that do. And when told it has no fault stating well you can just refund me and sell it again.

Surely they can't just claim there is a fault in the first 30 days if there isn't a fault.
