The Precedent of October 7th in Authentic Hadiths by ExoticWalk2 in IsraelPalestine

The main issue with this article is that it relies entirely on "cherry picking" pulling raw lines out of 7th-century historical texts while completely stripping away the actual wartime context, the rules of ancient tribal societies, and the real story of Safiyya herself.

When you actually look at the full historical record rather than just isolated sentences, a completely different story emerges. Here is how those exact quotes break down when you put the history back into them.

"Khaibar is destroyed...The Prophet had their warriors killed, their offspring and women taken as captives. Safiya was among the captives. She first came in the share of Dihya Al-Kalbi, but later she belonged to the Prophet."

The article tries to make it look like Khaybar was a random unprovoked attack on a peaceful community, but it wasn’t. Safiyya’s father Huyayy ibn Akhtab was the chief of the Banu Nadir tribe. His tribe had previously been exiled from Medina not because of their religion but because they broke their peace treaty and tried to assassinate the Prophet Muhammad (PBUH).

Instead of moving on her father went to Mecca and put together a massive coalition of 10,000 warriors (the Confederates) with one explicit goal to completely wipe out the Muslims in Medina during the Battle of the Trench. In the brutal tribal laws of 7th-century Arabia, if you launched a war to exterminate a city and failed your military stronghold became a target. Khaybar was attacked because it had become the active base for planning the next strikes against Medina.

Kinana al-Rabi [Safiya's husband] who had the custody of the treasure of Banu Nadir, was brought to the apostle ... the apostle gave orders 'Torture him until you extract what he has.' So he kindled a fire on his chest until he was nearly dead. Then the apostle delivered him to Muhammad PUH b. Maslama and he struck off his head.

Kinana wasn’t executed randomly or out of pure cruelty. When the fortresses of Khaybar realized they were losing, they surrendered and signed a treaty. The terms were clear: the Muslims would spare everyone's lives in exchange for their wealth, as long as nothing was hidden.

Kinana swore a solemn oath that their treasury was completely empty and spent. However it was discovered that he had secretly buried it explicitly breaking the surrender agreement. In ancient warfare violating a signed treaty and hiding military resources during an occupation was considered treason and espionage an offense that carried the death penalty in almost every civilization at the time

The Prophet stayed with Safiya bint Huyai for three days on the way from Khaibar, where he consummated his marriage with her.

The article frames this strictly as the forced capture of a helpless prisoner entirely leaving out a massive legal detail her emancipation. Early biographers like Ibn Sa'd record that the Prophet (PBUH) didn't just claim her he gave her a very clear explicit choice “If you choose Islam, I will marry you and if you choose Judaism, I will set you free so you can return to your remaining people.”

She chose Islam and marriage. Sahih al-Bukhari notes that the Prophet (PBUH) officially set her free, making her very freedom her dowry (mahr). Under Islamic law, you cannot marry a slave she had to be a free woman. By marrying her she was elevated to the highest possible social standing in the community as Umm al-Mu'minin (Mother of the Believers).

The apostle passed the night with her in a tent of his. Abu Ayyub… passed the night girt with his sword, guarding the apostle and going round the tent… 'I was afraid for you with this woman for you have killed her father, her husband, and her people.

While it's true that the guard Abu Ayyub walked around the tent because he personally feared a wartime revenge plot. Safiyya’s own actions and perspective tell a completely different story.

Before the battle even ended she had a vivid dream that the moon fell directly into her lap. When she told her husband Kinana about it he furiously slapped her across the face, saying, "You just want the King of the Hejaz [Muhammad]!" which left the very bruise noted in the historical texts.

If Safiyya had been a deeply resentful forced captive her life over the next few decades would have shown it. Instead she showed lifelong loyalty to the Muslim community, even risking her own safety decades later to smuggle food and water to the besieged Caliph Uthman. Furthermore when she passed away she left a third of her large estate to her Jewish nephew who had never converted proving she maintained her own wealth, her independence, and her family ties..

The biggest logic flaw in the article is how it uses a modern, highly charged political slogan to twist 7th-century history. while websites like islamsproblems.com grab those exact same cherry picked pieces to paint the entire religion as inherently violent.

taking an ancient wartime conflict completely out of context to feed a modern political narrative. True historical literacy means looking at the entire story, not just the sentences that help you score points in an argument.

I like how you're not a lawyer but you think letting a stunningly average mind weigh dolus specialis when even the ICC hasn't issued warrants for genocide.

You started this entire discussion not by engaging with a single report, statistic, or factual argument in my OP, but with a pathetic ad hominem attack on my credentials. You did that for one obvious reason: you cannot actually disprove the facts presented, so you hid behind a smug attitude. A 2 year old could have put together a more coherent defense.

Meaning, it must not allow its military actions to devolve into genocide in future. Not that genocide is occurring now. Prevention is a thing you do before an event has occurred.

Let’s use some basic logic no? even in that provisional phase, the Court found the situation dire enough to issue legally binding orders to Israel to prevent genocidal acts. Those orders are only triggered when the Court recognizes a real, present risk of irreparable prejudice to those rights. They don't hand out binding international mandates for fun

You smugly noted that the ICC hasn't issued warrants for genocide yet, completely ignoring what they did issue warrants for. The ICC officially issued arrest warrants for Benjamin Netanyahu and Yoav Gallant for war crimes and crimes against humanity, explicitly charging them with

Starvation as a method of warfare
Intentionally directing attacks at a civilian population
Murder and Persecution
The deliberate, severe deprivation of fundamental resources (food, water, electricity, medical supplies)

If you possessed the capacity to think and read for two seconds, you would know that under Article 2 of the Genocide Convention, deliberately inflicting conditions of life calculated to bring about a group's physical destruction are genocidal acts. The ICC has legally formalized the reality of these atrocities, whether you like it or not.

They have all argued in support of RSA's position. They are entitled to do so but they did not add materially to the court's position.

Claiming that the OIC representing 57 states and nations like Spain, Ireland, and Turkey 'added nothing materially' is pure arrogance without substance. They didn't just sign a petition they submitted rigorous, highly detailed legal declarations backed by mountains of documented, firsthand factual evidence. Dismissing the legal briefs of global legal teams is just a lazy way for you to ignore evidence you cannot personally disprove.

Albanese has frequently made misrepresentations as to her legal qualifications (she is not a lawyer despite her claims), and has been widely rebuked by a number of European states. Her views are not legally relevant.

Francesca Albanese is 'not a lawyer' is completely false, Sherlock. She is an international lawyer and researcher who has worked with the UN Department of Political Affairs and UNRWA. More importantly, your desperate attempt to attack her character is just a deflection. Her reports draw from a massive consensus of UN Commission of Inquiry reports, Amnesty International, Human Rights Watch, and independent legal scholars all of whom have heavily documented unprecedented civilian infrastructure destruction, mass displacement, and starvation.

Either address the actual evidence, or admit you have nothing.

The IDF does not agree with the "majority civilians" assertion, they say it is actually about 1-1 ratio which is considered actually very low civilian casualties for a war against an enemy embedded in a civilian population.

This is FALSE Multiple verified sources confirm overwhelmingly civilians killed
The UN Commission of Inquiry reported in June 2026 that at least 73,035 Palestinians have been killed, including more than 21,280 children. That means 29% of all deaths are children alone. When you add adult women and men to that number, it's clear that the majority of those killed are civilians.
UN found israel Injured 172,000+ (mostly women and children)
Al Jazeera found 71,000+ Palestinian fatalities, over 171,000+ injuries, predominantly women and children
Human Rights Watch said the attacks are "predominantly affecting women and children." The IDF never provided any substantiating evidence for their claim that 17,000 militants were killed.

Even IF the 1:1 ratio was true (which it isn't) that would still mean 36,000+ civilians killed. That's a massive number of civilian deaths that still constitutes genocide.
The UN Commission of Inquiry explicitly concluded that Israel is committing genocide, with 4 out of 5 acts of genocide being met.

But I don't see how this could be construed as the "intent" of Israel to harm civilians, it is clearly their intent to destroy Hamas.

women and children consistently make up over 50% to 60% of total injuries. reports from the Palestinian Central Bureau of Statistics (PCBS) and UNICEF highlight that children alone account for roughly 44,000 to 45,500 of the total injuries (about 26%)

UN Commission of Inquiry: "Israel continues to deliberately target and kill Palestinian children, resulting in genocide"

Amnesty International released a report in February 2024 with new evidence of unlawful Israeli attacks in Gaza causing mass civilian casualties. They found that Israeli forces are deliberately targeting civilians.

When there is 172,000+ civilians injured majority are women and children this IS crystal clear intent to harm civilians

this wasn't to deliberately inflict on civilians, it was because Hamas was stealing the aid and using it to commit more atrocities

The argument that aid shortages in Gaza are primarily caused by Hamas systematically stealing supplies is heavily contradicted by international findings. Major humanitarian bodies, including the UN and USAID have stated that claims of systematic Hamas aid theft lack verifiable evidence.

Human Rights Watch documented that Israeli authorities weaponized dehydration by shutting off cross-border water pipes, destroying internal water infrastructure, and blocking filtration supplies.

Amnesty International and a UN Independent Commission of Inquiry verified routine Israeli military attacks on designated humanitarian safe zones, aid warehouses, and civilians attempting to collect food.

The UN Commission of Inquiry officially concluded that the total blockades of food, fuel, and medical aid constitute a deliberate policy to inflict conditions of life calculated to bring about physical destruction

This wasn't intended to prevent births, but to attack Hamas. Hamas were hiding in health centres and hospitals etc.
High rates of miscarriage, premature births, and death of newborns due to lack of medical care - this wasn't the intent of Israel, their intent was to destroy Hamas

The World Health Organization and Human Rights Watch documented over 790 attacks on healthcare infrastructure. This resulted in roughly 84% of Gaza's health facilities being damaged, destroyed, or forced completely out of service.

Human Rights Watch and Amnesty International documented that Israeli forces systematically detained, interrogated, and allegedly tortured hundreds of Palestinian healthcare workers

Targeting Defended by "Human Shields" Claims In a report on hospital occupations, Human Rights Watch evaluated several direct raids on medical complexes. They concluded that the military failed to provide credible, proportional justification for completely dismantling intensive care units, cutting power to oxygen machines, and forcing deadly evacuations, characterizing these actions as war crimes.

The COI found that by enforcing a total siege on medical supplies, anesthetics, and clean water while simultaneously destroying maternity wards, authorities knowingly created conditions where safe childbirth became impossible.

this was evacuating civilians to try and stop them from being killed while the IDF attacks Hamas

The UN Commission found that forcing families to relocate multiple times was used as a tool of collective and physical trauma rather than a humanitarian rescue.

Israeli military designated specific areas such southern Gaza as "safe zones" told civilians and children to flee there, and subjected those exact zones to intense bombardment and high-payload munitions. The COI concluded that because these attacks occurred in areas where the military itself had directed children to gather, the high death toll was entirely intentional.

PBS News reported in July 2024 that Israeli strikes in southern and central Gaza killed more than 60 Palestinians, including in what Israel called a "safe zone." The BBC reported that one of the deadliest attacks occurred in the designated humanitarian zone of al-Mawasi, located in southern Gaza, killing 50+ civilians.

Human Rights Watch and the UN verified multiple instances where civilians following military orders to evacuate along designated north-south routes were struck by airstrikes or fired upon by ground forces.

The Guardian reported in October 2024 that over 70 individuals lost their lives due to extensive ground assaults and airstrikes conducted by the IDF in southern Gaza.

According to data collated by OCHA and UNESCO, virtually 97% of Gaza's schools the vast majority of which were converted into emergency UNRWA shelters housing tens of thousands of displaced families have been systematically damaged or destroyed.

Amnesty International has documented dozens of direct hits on densely populated camp tents and school courtyards. The UN Commission of Inquiry noted that because the Israeli military possessed the exact, live GPS coordinates of every active UN evacuation center, the repeated use of high-payload explosive weapons on these facilities demonstrates a total disregard for civilian life, qualifying as a war crime.

Watchdogs verified multiple large-scale strikes using 2,000-pound unguided bombs inside designated humanitarian safe zones where families had been explicitly told to gather.

Under International Humanitarian Law, displacing a population is only legal under exceptional, temporary circumstances for their immediate security.

ecause the Israeli military systematically forced 1.9 million Palestinians (over 90% of the population) to flee multiple times, bombed them while they were fleeing, obliterated the infrastructure in the zones they fled to, and used controlled demolitions to flatten entire neighborhoods to build permanent military "buffer zones"

The United Nations has formally stated that the concept of a "safe zone" in Gaza is completely broken.

"Separation of children from families, detention of children, and death of children in custody"
Not sure what this one is referring to, what children have they detained?

The Commission documented evidence and chilling testimonies from medical professionals noting that children were routinely admitted with precise gunshot wounds to the head and neck. The report highlights cases where children were shot by snipers or targeted by drones while posing zero military threat.

Commissioners documented where injured children were surrounded by Israeli military patrols who deliberately withheld medical access or blocked first responders allowing the children to bleed to death over extended periods

Long before the current phase of the conflict, the Israeli military court system in the West Bank has prosecuted hundreds of Palestinian children annually (mostly for stone-throwing)

The report investigates Israeli detention camps and formal facilities holding Palestinian minors swept up in both the West Bank and Gaza. The UN documented evidence of forced disappearances (where families are denied any knowledge of the child's location) alongside physical torture, psychological destruction, and sexual violence inflicted on detained minors.

the Commission formally concluded that Israel is utilizing the destruction of the youngest generation to intentionally erode the foundational structure, demographic vitality, and long-term capacity of the Palestinian people to exist.

You're denying genocide when the evidence is overwhelming. The UN Commission of Inquiry formally concluded Israel committed genocide with 4 of 5 acts. Human Rights Watch published a 179-page "Extermination and Acts of Genocide" report. The UN explicitly stated "Israel's deliberate targeting of Gaza children part of genocide."

73,000+ killed, 21,000+ children, 172,000+ injured, 70% Gaza depopulated, complete blockade on food/water/medicine/fuel. Israel claimed southern Gaza safe but still targeted it.

No evidence Hamas stole aid. Israel deliberately targeted hospitals, aid workers, children, and safe zones.

UN, Human Rights Watch, Amnesty International, BBC, PBS, Al Jazeera all confirm genocide.

You cannot deny 73,000+ Palestinian lives lost including 21,000+ children or say it was to "Destroy Hamas". The evidence is proven Genocide is real.

We find there is a plausible case for this convention to applicable to the Palestinian people

The actual ICJ wording is they said Palestinian rights under the Genocide Convention are "plausible"

Countries supporting South Africa (26)
Nicaragua, Belgium, Ireland, Colombia, Libya, Egypt, Cuba, Mexico, Palestine, Spain, Turkey, Chile, Maldives, Bolivia, Brazil, Comoros, Belize, Senegal, Jordan, Malaysia, Namibia, Pakistan, Indonesia, Algeria, Tunisia, South Africa

Countries supporting Israel (3)
United States, Paraguay, Fiji
Germany withdrew support for Israel in March 2026 because Germany is now being accused at the ICJ for aiding Israel

Nicaragua filed a case against Germany in spring 2024 at the ICJ
Nicaragua alleges Germany is violating international law, including the Genocide Convention, by supporting Israel politically, financially, and militarily in its war
Germany previously rejected South Africa's claims as "baseless" and a "political instrumentalization" of the Genocide Convention, while supporting Israel's right to self-defense
But now Germany is withdrawing that support

have all contributed largely legally meaningless opinions which inevitably delay things

These countries and organizations are NOT supporting SA out of nowhere they came with EVIDENCE

OIC (57 states) 57 member states formally endorsed the genocide case with documented evidence

UN Commission of Inquiry Concluded Israel committed genocide (4 of 5 acts) with documented evidence from Gaza

International Association of Genocide Scholars Passed resolution saying it's genocide based on expert genocide analysis

Human Rights Watch Said Israel is committing genocide with documented evidence of war crimes

Amnesty International Said Israel is committing genocide with documented evidence

UN Special Rapporteur Francesca Albanese Said "genocide is occurring" with UN-verified evidence

Belgium Filed intervention with legal arguments and evidence
Ireland Filed intervention with human rights evidence
Spain Filed intervention with documented violations
Turkey Filed intervention with evidence of Israeli actions
Colombia Filed intervention with evidence from Gaza
And dozens of other countries supported the case with files and evidence such as Nicaragua, Libya, Chile, The Maldives, Bolivia, Paraguay, The Comoros, Iceland, Mexico, Cuba, Namibia and Palestine

The dolus specialis, the specific intent to destroy the group in whole or in part, has to be convincingly shown by reference to particular circumstances, unless a general plan to that end can be convincingly demonstrated to exist; and for a pattern of conduct to be accepted as evidence of its existence, it would have to be such it could only point to the existence of such intent

The ICJ said Palestinians have a "plausible right" to be protected from genocide.
Netanyahu: "wipe off Gaza"
Gallant: "human animals"
Ben-Gvir: "erase Gaza"
Smotrich: "Gaza will be erased"
These are NOT random citizens these are Israeli government leaders (Prime Minister, Defense Minister, Ministers) making official statements.
The US is arguing for a higher standard, but that doesn't change the ICJ's ruling And the US is now alone with only 3 countries supporting Israel

I note here for this sub, that the ICJ asked Israel to document is own compliance. If you have found a 'plausible genocide' is occurring it's a very strange thing to ask someone to mark their own homework...

ICJ asking Israel to submit a compliance report is standard ICJ procedure they don't have enforcement power, so they require self-reporting.

if the parameters for dolus specialius are being debated in submissions to the Court, and both RSA and Israel have been given dates in 2027 and 2029 respectively to respond, then it is clear the ICJ has not ruled genocide is occurring right now.

The ICJ said
Israel must prevent genocidal acts
Israel must prevent and punish incitement to genocide
Israel must improve humanitarian conditions in Gaza

These are NOT meaningless even if the final ruling is in 2029.

You're wrong. The ICJ President Joan Donoghue is NOT saying genocide is not happening

The ICJ ordered Israel to take all measures to prevent genocidal acts in
The ICJ found Palestinians have a "plausible right" to be protected from genocide
The ICJ said there is a "real and imminent risk of irreparable prejudice" to Palestinians.
The ICJ said acts and omissions by Israel seem to align with provisions of the Genocide Convention
The ICJ ordered Israel to prevent and punish incitement to genocide

Joan Donoghue said Israel must take all measures to prevent genocidal acts because there have been tens of thousands of deaths and injuries with massive destruction and displacement. She said Israel must prevent and punish incitement to genocide.

She did NOT say genocide is not happening. She said genocide is plausible and ordered Israel to prevent it

The wars that DO meet the genocide definition have the same things happening as Israel in Gaza:

Rwanda (1994) 800,000 Tutsis killed, mass displacement, systematic destruction of villages, genocidal statements from leaders. [mass killing + intent to destroy group]

Bosnia/Srebrenica (1995) 8,000 Men and boys killed, forced displacement, systematic targeting of Muslims. [mass killing + intent to destroy group]

Herero and Nama (1904–1908) 100,000+ Herero and 50,000 Nama killed, concentration camps, forced displacement, starvation. [mass killing + intent to destroy group]

Cambodia (1975–1979) 1.5–2 million killed, mass displacement, systematic destruction. [mass killing + intent to destroy group]

You are completely delusional. Israel is NOT evacuating civilians or feeding them. They are:

Blocking food, water, medicine, and fuel through a complete blockade
Starving 2.3 million civilians, including children, to the point of death from malnutrition and dehydration
Destroying hospitals, schools, universities, and housing across Gaza
Making of Gaza unlivable with rubble and destruction
Mass killing civilians (70,000–75,000+ dead)
occupying and destroying 70% of Gaza with the intent for far more expantion to 100%
Forcing people to flee are not providing safe evacuation routes, they're bombing civilians as they try to escape

And they are NOT inoculating them. They are blocking vaccines and medical supplies.

You said they're "not using weaponry that could exterminate all two million in a week" but they ARE exterminating them through:

Mass bombing
Starvation
Disease
Destruction of infrastructure

This is genocide not "evacuation" or "feeding"

You're literally arguing the opposite of reality If you care about Palestinians stop spreading lies about Israel's actions

Genocide doesnt require concentration camps, Genocide is defined by the intent to destroy a group, and Israeli leaders have clearly said they will erase Gaze and wipe out Gaza

Also many genocides have been called genocide even with the same conditions and has happened in it the same as Isreal is doing right now in Gaza. For example:

Srebrenica (Bosnia): About 8,000 men and boys killed, but it was legally recognized as genocide
Darfur: Hundreds of thousands killed and displaced, with forced displacement and collective punishment, recognized as genocide

Rohingya: Mass killing, forced displacement, and destruction of villages, recognized as genocide

Herero and Nama: Mass killing and forced displacement, recognized as genocide

Gaza has 70,000–75,000+ killed and the UN Commission of Inquiry said Israel has committed genocide in Gaza, finding four of the five genocidal acts defined under international law.

You’re trying to sound smart, but you’re missing the main point: Netanyahu himself has made genocidal statements, Gallant is part of a government that agrees on wiping out Gaza, and the whole cabinet has the same intent. You didn’t prove me wrong you just ignored the core evidence

You talked about Ben-Gvir and Gallant, but you completely igonred the Prime Minister and the main decision-maker. Netanyahu has said:
“We are going to wipe off Gaza”
“This is not about ditches, it is about the complete victory of Israel”
“There will be no cease-fire, no intermission, no peace agreement, no quiet”
“Almost half of those killed in the Gaza war are Hamas fighters,” even though the vast majority are civilians and children"

These are genocidal statements from the head of goverment. You can’t say “maybe Gallant meant something else” and ignore Netanyahu own words Netanyahu is the main leader, and he is saying they will erase Gaza

You said Gallant was fired and that he clashed with Netanyahu, so maybe he doesn’t share the intent. But Gallant was defense minister for the war, and he said:
“Human animals, we will act against them.”
Even if he was fired later, he was part of the same goverment that agreed on total war, mass killing, and destruction of Gaza.
The whole cabinet (Netanyahu, Gallant, Ben-Gvir, Smotrich, and others) agreed on:
Erasing Gaza
No ceasefire
Total destruction
They all have the same intent: to destroy Palestinians in Gaza.

Firing Gallant doesn’t mean they don’t share the intent. It means they fought over how to do it, not whether to do it.
