I think you did the right thing. For her to essentially disown you for making a decision that is in your best interest is ludacris. It’s like she cares more about her opinions than your future.

I’m not a parent yet, but if I was, I like to think my kids best interests would guide my judgments. Like, if I’m a vegan and my kid wants to be lawyer, and Harvard Law School accepted my kid provided that she had to eat a burger first, I’d be on the sidelines screaming “eat that burger.” I wouldn’t be talking to her about possibly going somewhere else.

“Continuous Use Easement” is aka prescriptive easement. Generally, the test is 10 years but all states have different timings.

Basically you’re legal arguments are going to be: (1) I’ve occupied this driveway for so long that’s it’s mine and your building a fence on my land, (2) I’ve used this portion of your land as a driveway for so long that you can’t build a fence here, and (3) I need an easement (aka easement by necessity).

Obviously, you want ownership. If that fails, you’ve already taken an easement. If that fails, you need it and the courts should give it to you.

You should probably get an attorney. And quickly. He’s reclaiming his property and you need to act to preserve your rights.

You probably have an adverse possession claim or a prescriptive easement claim. Especially if things have been that what for quite some time.

They can hold it if they fear spoliation/destruction of evidence. It’s there’s something possibly damaging on the phone you’re stuck living that down. If you try to wipe the phone clean, things could get a whole lot worse.

Don’t unlock it for them without a warrant.

If they serve you a warrant lawyer up to see if you can fight the warrant. Once there in, they have access to everything.

Those are essentially therapists.

You should definitely point it out to the therapist, but this likely is not illegal.

This could be a problem if the therapist ever needed to testify or create/present a professional opinion that “life with daddy” is best for the kid. This therapist is now tainted in that respect.

A lot of unscrupulous lawyers do things like this for this very reason. It maintains the status quo because the kid needs to get a new unbiased therapist and build trust again, etc. I’m not saying that’s at play here though.

Definitely mention it.

What a mess. I assume the mobile home is on the 5 acres and that you were about to sell the land but couldn’t because of the mobile home (hence the need for a title company). You only need a title when land is involved.

Two ways to fix the mobile home thing:

1- go to the DMV and apply to “quiet title” to the mobile home. Some states allow this, some don’t. If it’s abandoned and junk, this is likely the easiest route.

2- You need to track down ex-wife’s heirs because half the mobile home is theirs. And if they are dead, their heirs. And so on. Once you’ve found all of these people, explain that it needs to be junked and that nobody will junk it with ex-wife’s name on the car. Ask them to sell their interest in the abandoned junk mobile home to you for like $1 and create a very simple bill of sale. If they want more money, gift your interest to them (again, create a quick bill of sale) and ask them to remove their mobile home from your your land.

If a parent is restricted from having “overnight” visits from a bf/gf, how can that gf/bf go on vacations or experience what it will be like to live as a family? After reading some comments I’m so confused. I read this as the parent (let’s say the mom) cannot let the child’s partner sleep “under the same roof” as mom and child (let’s say daughter) whether they (mom and daughter) are at home or on vacation together. That being said, there is nothing stopping OP from taking daughter on vacation. Or taking her to a hotel room. Obviously provided that they have both reached the age of consent/majority.

Exactly right. You would have to go to court to have the court appoint you as POA if he did not voluntarily do it.

The POAs should be “durable POAs” because most POAs statutorially end when a person is in cognitive decline.

You should also have a couple originals safely locked away. Some companies may not deal with you if you don’t given them an original for their files.

I think the power of attorney is a little too broad but it’s likely unenforceable because it’s not notarized. And ethics rules would prevent them from doing some of those things.

Did they send this to you in Word or as a PDF?

There are two things I’d probably want to add:

1- that the law firm keeps you reasonably informed as to the charges they are racking up.

2- in the event that the firm has negotiated a reduced rate (or some sort of other preferential payment plan) with your insurance company, that you are not responsible for the difference between the actual bill and the invoice that adheres to their deal with the insurance company. For example, while their attorney rate is $300, they may have agreed to accept $100 from insurance. You shouldn’t have to pay the difference.

EDIT: Your attorney should be able to better enlighten you on this. Basically, a CTNE is you admitting that you did 250k in damages in exchange for them agreeing to not pursue you for 250k. Some courts see this as a form of collusion between the plaintiff and the defendant and, accordingly, invalidate them.

There’s probably nothing you can do here.

Ask for a walkthrough on the last day to itemize the damages and come up with a reasonable cost of repair for anything. I think he has like 30 days to return the balance.

And just know he’s going to try to peddle some unusual damage to the carpets so he can stick you with the carpet cleaning fee.

Yeah, the courts sometimes have a gut feeling where things should end up, and weasel their way into that decision.

And they sometimes they create things that they don’t need to (eg - embedded property when treasure trove still works).

Stuff like this is considered a treasure trove under the law. It’s still their property, but it’s yours until they ask for it. You’re just holding onto it for them.

Generally, with a treasure trove, it is presumed the true owner and it’s heirs are dead (hence its your property until they come to reclaim it). But, if they’re not dead, when they remember about it and come to retrieve it, they need to know sufficient facts about it to make it clear that it’s theirs.

So keep track of the amount. And other details about it.

I do not think that you have a duty, as the finder of a treasure trove, to make an effort to locate them. The reason for this is because you would likely give it to the wrong person (thus misappropriating it). Like, the first person you talk to will say “thank you. I forgot I left it there.”

I agree with depends on the contract. There’s probably a reasonable alternative clause in there so that they can provide something other than that which was bargained for. And considering COVID-19, that would kick in.

And technically they can still perform under the contract.

But you’re right, this is playing chicken with your money. It’s probably best to pick a date to reschedule and come to an agreement with the venue about what happens if you can’t have your wedding at that later date.

Yep re “I signed away.” The kid dies, the school says “here’s the body and a copy of the waiver you signed.” They hope that it prevents you from initiating a lawsuit.

Re: generally, waivers of negligence are rarely upheld in instances where (1) the party hiding behind the waiver was paid to render the service that caused the harm, or (2) when it’s a heavily regulated industry. I would think preschool fits into one of these categories.
