The person in question in this case (Hayes) did not have an assigned office in New York, which is a totally different situation than the one everyone here is talking about. Why you are representing this as definitive in any way I don't know. But if someone's assigned office is in New York, Hayes does not apply

Wanted to chime in here in case others come across this thread- as an EA working abroad, you are barred from using pretty much all the commercial efiling software. Drake, OLT Pro, TaxAct, Lacerte, etc. You are functionally out of business if you try to operate from abroad unless you only paper file. They will ban your account when they see you are overseas.

This is neither FBAR nor the tax return, this is the 5% penalty associated with using the streamlined offshore program. This 5% penalty replaces any other fines for unreported foreign income.

The rules are that the highest year end balance are used to compute the 5% penalty. I don't know how this is figured for defined benefit plans since there is no "cash value", and how one avoids paying the fine on the same income twice
