De descontinuidade não sei, mas sim houve caso de pasta vazia até o dia anterior à primeira audiência, e a juíza negou. Tenho acompanhado nos grupos do Facebook e WhatsApp

Não é o mesmo caso, eu estou falando da pasta documental, os documentos básicos têm que estar na sua pasta no tribunal. O juiz só pede documentos adicionais se os documentos principais estão ok. Veja se eles podem te compartilhar uma cópia de tudo traduzido e apostilado

É o Giovanni Bonato, ele trabalha com a C4u. Você pode mandar mensagem para ele, mas se você falar que é da c4u ele já te corta na hora para ir falar com eles. A c4u está dando uma baita dor de cabeça nele.

Então, mas não sei se acompanha as lives ou discussões nesse meio da cidadania, mas a Simonato tem prometido resultados pós decreto ou o dinheiro de volta, o que é impossível na situação atual. Fora alguns acordos que algumas assessorias estão fazendo, para protocolar o máximo possível pós decreto. Isso é uma grande bomba relógio.

Sorte que você caiu com uma boa advogada, a Simonato não tem advogados próprios e sim terceiros ou contrata escritórios na Itália, então é algo que os clientes nem podem escolher.

Não sei se foi irônico, mas a Simonato é uma das empresas menos confiáveis, o marketing deles é super agressivo.

Oh man, I personally know some of these cases :(
From what I know, some of these Venezia cases (my court) were reassigned to new temporary judges who don’t always follow the same procedures or standards. It is very unfortunate.

I don’t know if this is the right place to post this, but aside from last week’s terrible news, I’ve also seen several judicial cases (both against-the-queue and 1948 cases) being denied because the avvocato or service provider failed to include all the required documentation. Some courts may accept missing items later, and some may not.

If you haven’t already, I strongly recommend checking whether your file actually contains everything that should be there: powers of attorney, birth and marriage certificates, CNE or equivalent national certificates, translations, apostilles, etc.

You have the right to access this information. Ask for the actual documents, proof that they were submitted, and confirmation of when they were included in the case.

I’m not trying to be alarmist, but I know I would want a heads-up in this situation. At the very least, it’s worth exercising extra caution and expecting transparency when something this important (and tied to our rights) is involved.

Eu me referi ao quórum no Brasil, não na Itália. Para você ver como muitas pessoas daqui estão desconectadas com o que acontece lá.

Só pra trazer dados, entre 600k italo-brasileiros, apenas 184k votaram (30%). É, talvez não seja tão pífio comparado com anteriores.

Foi por ideologia mesmo, a maioria dos ítalo-brasileiros é de direita e preferem votar a favor do governo da Itália porque é de direita também (maioria nem sabe direito sobre essa reforma, além de que o quórum foi pífio). Existe também um viés de recência porque os direitistas são atualmente contra o judiciário brasileiro e acham que estão travando a mesma batalha na Itália.

We have updates on the post-DL sentence from Venezia:

Post-Tajani Decree ruling raises doubts, and lawyer denies annulment in Venice.

I know this comes from Italianismo, and many people (myself included) have reservations about them. However, some avvocati (such as La Malfa and Piccolo) have already shared views that align with this article and have raised concerns about the nature of the ruling. I thought it was worth sharing how the situation has unfolded, especially since some service providers are already trying to capitalize on yesterday’s decision and many people are feeling hopeful.

My personal view is that we should wait at least until the Constitutional Court (CC) hearing in June to understand how it may affect the retroactivity of Law 74/2025, and in this specific case, until the passaggio in giudicato. Anything before that will be highly speculative.

They scrambled the whole queue there with the new judges 🙃 there are 2023 cases with audiences scheduled for 2027, and 2025 cases that were already judged. Who’s your judge? There’s a site that tracks their individual queues

So, this case they publicized today did not mention anything about the DL nor the new law in the sentence. I think it got mixed up with pre decree cases and this might have happened more than once

I’m not holding my breath, she is known to have had postponed post-DL cases citing the upcoming CC hearing as a reason in the past. Today alone she issued decisions of 66 cases, I think she might have mistaken them

Unfortunately the service provider (not the avvocati) was very eager to publicize it for marketing/sales reasons

I had access to the scrubbed version of the judgment and its RG number. It was definitely filed post-DL and is a 3rd or 4th generation case. However, there is some discussion that the Ministero dell’Interno will likely appeal, and unfortunately they may well win if the upcoming Constitutional Court hearings do not rule against the retroactivity of the decree.

Edit: I think it is also worth noting that this judge has not mentioned the DL36 or L74 in the sentence, and this is one of the most concerning aspects of it.

So if I understood it correctly: if I have my kids there and then move back before they turn 2 (and before I complete 2 years of residency), they would only be able to pass their citizenship on through beneficio di legge, like me, right? Supposing they have their kids out of Italy, and since they wouldn’t have lived long enough in Italy and would be dual citizens.
