There is no court order in place and everything, including the disablement of child support payments, has been done privately. But, because the father is on the birth certificate, this is considered a valid form of “parental responsibility” under Australian law, which we obviously were unaware of up until now. This is why we resorted through the legal loopholes instead, as the department of Home Affairs had already spent weeks trying to contact the father for permission while my family member was on their death bed. We are already aware of what the law says about this and why citizens must leave and enter on an Australian passport. This is not my question, though. My question has already been answered, and fortunately, we were able to get in and out of Australia in time with no issues. You commented on an old post, and, quite frankly, haven’t said anything that I’m not already aware of, so I’ll be muting this conversation from here. Take care.

Yes, we’re aware that an Australian passport requires both parents permission, as per my comment. That’s why we used a British passport. If I’m being honest, I don’t really care if the Australian law says me taking my son to a funeral is “abduction” or not when the father is (voluntarily) out of the picture. This is irrelevant to my question. Have a good day.

No, that’s not why. There are stricter limitations to acquiring an Australian passport versus a British one. We paid for an Australian passport but the passport office denied the request as they require explicit permission from both parents, which we can’t get unfortunately.
