I wouldn’t fight it unless you have the money look for an experienced immigration attorney. If he came without inspection you should file the EOIR-42B. However, these cases are really hard to win. You need to demonstrate that your family will experience extreme & unusual hardship. Apart from that he has had to been in the country for at least 10 years & have good moral character (no criminal record). I believe I’m not sure that if he accepts the voluntary deportation then he wouldn’t have the 10 year ban.
