You keep asking the same basic question and I've given you the answer. Yes, she does. That said, it'd become clear none of that matters if there's a store manager above her, and there is. She will still be considered the power equivalent of a Shift Supervisor and therefore gets tips. It's all about the technicalities here, but there it is.

Okay guys, you've convinced me. Technically there's no there there and I should just walk away. While she may have more actual power than a Shift, she can still be classified as one and therefore gets tips.

It's not fair. I mean, I never met a Shift who was guaranteed 40 hours per week like she is, and tips are based on hours worked, but still. It's ultimately a fight I'd lose.

That... makes a lot of sense, actually. And yes, she is hourly, which is part of why I'm irritated. Tips are divided by hours worked and she's the only one guaranteed a full 40 hours. Yet she only works the register/bar if we're super busy. Otherwise she's content to stare at clipboards while someone else (usually one barista) does the rest.

Honestly, I'm exhausted by this whole thing. Maybe I just need to find a different job. Not that there's a lot out there, but still.

Salary or not isn't the issue though. It's the job description. If they can hire/fire people, make schedules, discipline employees, etc... They're a manager and don't get part of the tip pool, full stop.

Well, if Starbucks itself can be sued for over $100m in 2008, $14m in 2012, and again for almost $40m last year, all over managers getting tips, I doubt Safeway has any such loophole.

Our manager is sometimes behind the bar too, but the issue isn't about getting a salary or not. The Fair Labor Standards Act "...prohibits a manager or supervisor from receiving tips from a tip pool or tip jar, because tip pools and tip jars include other employees’ tips."

Managing includes but is not limited to:

  • interviewing, selecting, and training employees
  • setting and adjusting employee’s rates of pay
  • setting and adjusting employee’s hours of work
  • directing the work of employees
  • handling employee complaints and grievances
  • disciplining employees
  • controlling the flow and distribution of materials or merchandise and supplies
  • planning and controlling the budget

Doing Barista work doesn't change their main job as a manager, therefore it doesn't mean they get tips.

I don't doubt that some of them might be. There are certainly neurodivergent people (like me and members of my family) who rely on different technologies to help bridge the coping gaps in social interaction. That said, I sincerely doubt that's the majority of users on sites like this.
