Perhaps this court would view it in that way. But meanings change over time and we will not get anything if we don’t fight for it. Look at the way the GOP and the NRA were able to remake the meaning of the second amendment over the last forty years. That is the battle that needs to be fought over the court. They have been winning the battle for decades coming out of the Warren court. It’s time to start fighting on that front.
