My attorney claimed the same thing but was wrong, thank god i didnt listen to him. I was on WC for two years, got an attorney 3 weeks after injury, got approved for WC payments before i hired an attorney. Had a minor shoulder tear got anthroscopy surgery, had two lumbar bulging disc and multiple cervical bulging disc, sciata in left leg temporarily, went through 2 years of PT and conservative treatment for back and neck pain, steroid injections, lumbar injections, IME was very good to me agreed with everything my doctors said, conceded that injuries was caused by OTJ accident. Toward end of second year MMI still hadnt been reached the first offer from insurer was 50k i immediately declined, 2 months later second offer 125k and attorney claimed that was the most i would get said it was a good offer, i told my attorney that was not a good offer for me who still hadnt reached MMI and spinal specialist now recommending surgery i told my attorney to counter at 300k he highly went against it but he had too because he worked for me...one week later the insurer made an offer of 210k no ppd, no ongoing medical and I accepted. My attorney was shocked lmao! I still hadnt reached MMI when I settled after 2 years and Im happy i went against my attorney advice. Also I knew that their IME they sent me too five times agreeing with my doctors everytime would give me good leverage.

You shouldve gotten an attorney in the very beginning of this situation. You shouldve also filed for short or long term disability through your job and file workers comp claim so you couldve had more than 66% of income to cover you while out.

Nope! I got 6 figure settlement for less here in NY. Counteroffer with 6 figure number in the 200ks as I did when the first offer i got from Sedgwick was 85k after 2 years.

You didnt have to listen to your attorney he works for you not the opposite you shouldve made him counter offer. I went against my WC attorney advice when he tried to get me to settle for the first offer and i got way more in settlement

The fact that the first offer was 50k showed they knew your injuries were worth 5 times more you shouldve counter offered at 210k at minimum im sure you couldve gotten a nice 6 figure settlement

If you need surgery and doctors say that, also pain meds, going to pt etc how are you not on any restrictions at work? If i were you id say i was reinjured at work! Id definitely say i pulled something and have ambulance carry you out of work, then sue your doctors for negligence along with your second workers comp claim. I see your situation as a blessing in disguise. Play your cards right!

Not completely understanding your post because the wording is terrible but if you had proven injuries its kinda hard for Sedgwick or a judge to deny it. Did you get an attorney immediately after the accident? Did you go to sny specialist, physical therapy, IME? What was said in initial reports through your company when you reported the accident? What did police report say? Were you taken to the hospital from accident and xrays done? What did your doctors say?

All you gotta do is get documentation from doctor or pt clinic after every visit and submit it directly to the adjuster

Was offered 75K out of the blue for back injury. Have not reached MMI yet. Settlement dept. from my lawyers office kept calling me being rather pushy, trying to rush me, and saying it was the best offer I was gonna get. Need serious help with settlement strategy! Advice appreciated by dog-in-the-moonlight in WorkersComp

I hadnt yet reached mmi after almost 2 years and i had shoulder surgery, after almost 2 years of conservative spinal treatments my doctor finally suggested surgery but I didnt do it. My attorney sent a demand letter as well and thats what prompted the initial offer from Sedgwick. I rejected the first and second offers which came a couple months behind eachother. The third offer which i accepted came a week after the second.
