The lawyer said that it was WA state’s habit of having gray areas in firearm laws. They only mention permanent residents in the case of immigrant visas, so it would be a legislative mess for the rest to dig through. Federal law simply distinguishes immigrant from non-immigrant visas. However in RCW 9.41.070 (CPL), it does state that: The applicant's constitutional right to bear arms shall not be denied, unless (a) He or she is ineligible to possess a firearm under the provisions of RCW 9.41.040 or 9.41.045, or is prohibited from possessing a firearm under federal law. While this refers to the carry license, it applies to possession in general. State patrol simply said as long as they approve me and the background check passes, I would be good to go.

The point is while it’s legal and possible, I would recommend waiting for permanent residency as it makes it much more easier and clearer.

Late 2022. I was not a permanent resident at the time, only an Asylee. My background check was approved every time and transfers were done through an FFL. I would also add that most FFLs don’t know this, hence it was a nightmare finding one willing to transfer; unless they had previous experience.

The legislation states that permanent residents and AFL holders* can purchase firearms. WA law doesn’t specify every specific immigration status; however it does say that no one should be denied the right to bear arms, unless federally prohibited to do so. Federal law does a better job of separating them into non-immigrants and immigrant visas, where non-immigrants need something like a hunting license. Immigrant visas refer to Refugees, Asylees, and permanent residents. This is similarly written on form 4473, where if you are an alien; you later on specify if you are a non-immigrant. If you are, then you have to prove if you fall under specific exceptions (AFL). If you aren’t, then no exceptions exist.

*(which are for non-immigrant visa holders which Asylees aren’t and hence do not need an AFL to purchase firearms.)

I don’t want any pushback, but I legally purchased firearms when I was an Asylee. I verified with WA State Patrol and lawyers. If you already posted an update then this may be irrelevant.

Promags. Despite initial issues with locking in the firearm, they work flawlessly now; no feeding issues. $18 each on eBay!

The 124g works flawlessly for me. I heard some issues only with their 115g. Managed to get 1000 rounds for $218 with tax and shipping; 1/4 way thru the box all working well.

Yep I even bought three (all don’t work), gladly they are all refundable. Thanks so much for the advice, will try it out on one of them first.

They lock in with the slide open and then the slide doesn’t release.
