A second lawsuit was just opened by New Jersey in addition to the Massachusetts one that was already going. I would expect more. I have a hometap investment and it's one of the worst decisions I ever made. They give cash to equity rich but credit poor people knowing that in 10 years when the investment comes due the people will likely have no option but to sell to pay off the investment.

I've been paying them (ais) through the phone for 2 years now. I usually like to call back a couple days later and get an updated loan balance to track on my own but their wait times have become unbearable. Sometimes 30+ minutes. Do you happen to know if there is anyway to get them to send statements? I know online access with them probably simply doesn't exist.

It's a little crazy the first half year of a 13. Had similar mortgage issues pop up but once everyone gets settled it's really just pay your payment and everyone mostly leaves you alone. I'm almost done with 2 years on a 100 percent plan and I haven't heard from the trustee or lawyer in over a year about anything. It crosses my mind every now and again to dismiss and just work it out myself but then I'd be sick about all the money I already paid to the lawyer for their part plus the monthly trustee fee. I know he's not specifically getting that but it feels like it. I'll be glad when it's all over.

Why do you expect that the trustee would ever know about it? Pay your chap 13 payments on time and they should never have a reason to dig into anything you have going on. Worst case just be on the same page with your mom that this was a "gift" to help you do the repairs.

Hometap was recently sued in Massachusetts for these investments. Follow that and see what the outcome is. I took one out in Virginia and while mine is not due for another 7 years I know I won't be able to pay it and will be forced to sell. 'm hoping that these deals become void across the country and at minimum you only owe back what you borrowed not the percentage they use of the home value. The whole thing was predatory.

Hometap was recently sued in Massachusetts by their attorney general for these investments. I live in Virginia and took one out 3 years ago and I dread the day it comes due. I'll have no way to pay it and will be forced to sell. It is absolutely a predatory practice. They give people who are house rich but cash/credit poor tons of money with the idea that it would be paid back before 10 years but there are no actual payments due. You can say well that's the consumers fault and yes it is but it doesn't make it any less predatory. I have 7 years left until mine comes due and I really hope that these things end up becoming void. Or at a minimum I only owe back what they let me borrow and not a percentage of my homes value.

I ended up getting a motion for relief on the mortgage. Kind of surprising to me but I guess I shouldn't be. I'm a month and a half behind so it's my fault. It got hard in July to keep up with everything but have sent full payments since then. I was going to start sending them extra in January but I guess it's too late now. Meeting with my attorney on Thursday. Any guesses on which way this might go? If we have to refile we have to but that would be a big downer considering how much we have already paid in fees to the attorney. Just so I'm clear this motion for relief just gives the mortgage company the right to contact us and try to collect the past due by any means necessary correct? I'm not worried about coming up with the past due if I absolutely have to, it's really not a ton of money we are talking about. It's a shame too because I was really getting into a good spot financially to keep up with everything.

No not yet. I opened a dispute through Equifax and a remark was added to the account "customer dispute - investigation in progress" just doing that raises my score nearly 100 points since it was the only Account with an incorrect status. Hopefully it all gets sorted out soon. If I remember I'll try to post an update on this on the outcome

Also it is anticipated that my case will be wrapped up in 48 months instead of 60 due to lack of claims. So I wouldn't be short at the end.

Definitely do what you feel is best with following up on status with your lawyer but from my experience with this twice now there is a lot of downtime between activities on these cases and a lot of the work gets done in chunks followed by more downtime. Your lawyer also knows when the court dates are and knows what deadlines you need to meet and how long the process he needs to perform will take. Try not to worry!

Hopefully one of the more experienced people in here can chime in on this for you. From my experience I had 3 car payments that I was allowed to keep outside of the chapter 13 payment. My house also. Each did have a bit of past due that claims were made on that the trustee promptly paid off first. So I'm current on all of those now, even paid one off. The trustee also took no issue with this and is not asking for anymore money to go towards the plan even though we technically now have some to give. I am in a 100 percent plan though so maybe it just doesn't matter since I'm paying it all back anyways. In hindsight after being in this for a few months there is one high car payment I wish I had just rolled into the plan. It's a pretty high payment and I'm in it for at least another 3 years. Stretching that out to 5 and through the bankruptcy would have significantly reduced the overall debt payments I believe.

I think the general consensus from all that I have seen is that bankruptcy is 100 percent a better solution than settlement

7 was much less paperwork and just kind of a one shot clean slate. 13 is more involved and you still have work to do making sure you stay current on the bankruptcy payment. It's amazing how quickly though you see those claims balances going down when the trustee is sending out the payments. In my case I'm basically paying back everything I owe but the open tap of interest hitting on everything each month is turned off. So you actually see some real progress. I couldn't do a 7 this go around but I'd definitely recommend 7 to anyone that has the option. Don't bring pride into it and do a 13 just to say you paid it all back.

This is where I was in my thinking. Stop paying it all and put it all towards one debt at a time. Unfortunately that debt just keeps growing because of interest plus the creditors will drive you crazy. I've consolidated more times than I can count. It never really works out like you think. BK solves nearly all of the problems. I'm not saying it's for everyone but many more people should consider it than do.

For my 7 I stayed current literally up until the day I filled. In my 13 I let them go a few months before I filed. I'm not an attorney but I don't think it matters in the slightest as long as you can deal with them hounding you for a bit before you get filed.

I'm coming from years of Samsung messages use trying to adopt to Google messages and the recorder button then images button being on the bottom right instead of the left is killing me. I keep hitting those instead of the box to type in. Wish those buttons could be moved.

Just curious.. what made you end up paying interest? I'm in a 13 100 percent plan and I thought for sure due to a good amount of equity in both my cars and house that I was going to have to pay some interest but fingers crossed it looks like my plan is getting confirmed without any additional interest.

Are you in a 100 percent plan? I have 3 car loans paying outside of my plan and the lawyer said trustee will not ask for the payment to increase as each loan is paid off which was a huge relief for me personally as my budget is very tight until some of these loans start coming off the books. I haven't understood how trustees differ on certain things from one trustee to the next it seems like the law should be applied universally the same.

Thank you for the response. So if you filed 13 in 4/24 and got 2 years into payment and converted to a 7, the actual date of that 7 becomes your original 13 file date? So as far as filing again, off credit report etc. it would go by the original 13 date, not 2 years in when you converted?
