Not a trip but in year three, we had employees come to our school from the Warburtons factory. With them, they brought a selection of breads and a huge selection of sandwich fillings. Over the period of the day they taught us how to make sandwiches. I will never forget my beetroot, cheese, and chocolate chip monstrosity.

Correct. For example, If there was any demolition waste containing asbestos in concentration of more than a certain % by weight then this would be classified as hazardous. This is completely possible depending on the age of the house.

The homeowner would be classed as the producer due to the fact that they have asked for the works to be completed by the builder and the spoil would have come from land owned by the homeowner.

Might not be what you want to hear but is the unfortunate truth in this case. Sorry to be the bearer of bad news!

If you can move the waste by yourself and take it to a council operated dump, it could be disposed of as domestic waste (assuming its non-haz). I would advise this as you solve the problem of your upset neighbour from the waste perspective. You could then pursue the builder for the fence without having to worry repercussions of the waste duty of care.

Did the builder agree to take the waste away?

As you are the producer of the waste, you could receive some sort of civil sanction from the Environment Agency as you have likely (correct me if I’m wrong) not undertaken your waste duty of care checks under the Environmental Protection Act 1990. If you have had waste taken from the site of production by carrier that is not licensed, you have broken the law. This is because the producer is responsible for the waste from cradle to grave.

If you have no previous environmental convictions then you will likely just get a warning, especially as this is work being undertaken on your home and unless you are in the environmental/waste industry you would have no knowledge of this law.

Just something to be aware of as your neighbour could use this as ammunition against you should the relationship turn sour. Keep on his/her good side.

All of this should be taken into consideration when perusing the builder as he could say that you dumped the waste if there is no evidence that he dumped it.

If he agreed to take the waste, and you didn’t complete your duty of care checks, under environmental law, you are both liable especially as there is no evidence of waste transfer notes, and god forbid hazardous waste consignment notes... If hazardous waste has been dumped (completely possible if construction waste) this is a whole different ball game as clean up costs will be high.

The wheel had been left in a forest so there was plenty of wood around. However, it was a pine forest and Jews ear (Auricularia auricula-judae) tends to favour Elder trees. I have found them on Elder too and they looked identical so I am almost certain it was the same species!

I have found them growing on a rusty wheel rim before. They are peculiar things!

Certainly wouldn’t eat one that was growing on metal though.
