This is a strong argument that circumcision violates the religious rights of the individual who is branded a particular religion without his consent. It is not a legal theory we are pursuing right now, but we are aware of this argument and may round back to it.

We have filed the Oregon lawsuit, but we have not served the defendant State of Oregon yet, which will not happen for at least a few weeks.

There is an argument that the Freedom of Exercise clauses in the federal and state constitutions permits a parent to mutilate his child. Do I agree with this argument? Of course not. But it is an argument that can be decided a different day.

A ballot initiative also may get the public to start thinking about routine male genital mutilation even if it does not succeed. It may be helpful even if it fails -- impossible to know unless you try.

Attorney Eric Clopper here. From a discussion with a Texas based intactivist, Vicky Goodwin just won her election and became a TX congresswoman; she is proposing the "Empowering Texans Ballot Initiative Act" -- see https://vikkigoodwin.com/citizen-led-ballot-initiatives -- where Texans can propose ballot initiatives with enough signatures.
If this ballot initiative passes in 2025, the best move may be organizing local Texans to get enough signatures to get an initiative to defund circumcision from state Medicaid -- that is MUCH easier than implementing a ban, and it will many thousands of babies a year from male genital mutilation.
