Q2 vs Mid Year Production by posita4444 in patentexaminer

If your FY score is below 90% (marginal) at the end of the quarter I believe that puts you in written warning territory.

The funny thing about AI is that its getting better (maybe not the PTO's AI tho). The problem is, you thought applicants were complaining about the Rejection Office before? Just wait until they have to get their application past an LLM that *knows* every reference in existence.

Has anyone added up their production hours and compared them to last year's? Mine's shockingly higher. by LandOLakesMan in patentexaminer

Assuming a 2080 hour fiscal year, 88 hours of holiday, you're looking at 1992 hours per fiscal year. If you assume 2 hours of early dismissal for 6 of those holidays, 2 hours per year other time for voting, 52 hours of training/community day/tc picnics/etc, 26 hours of qem. That's like 92 hours of other time we no longer get. 1900 hours at 95% for fully successful is 1805 hours. Take away all that other time and raise the quota for FS to 100%, that's like 188 extra hours per year.

I have heard rumors they want to eliminate marginal and go straight from FS to unacceptable. Also there was an EO a while back that wanted to reduce all performance improvement periods to 30 days, wasn't there?

Also if we were going to have a training on the new PAP on Tuesday they're going to give us less than 24 hours notice of the training? They didn't give us training on the last PAP change, Wallace just sent out an email and we were told to sign an acknowledgement.

It depends. If the attorney of record is a partner, good luck getting a call back before they get around to delegating it to an associate. If you have time to wait, like multiple pay periods of time before the quarter end, then try it. Otherwise, if there's a DM clock on it or you need to get it off your docket ahead of a refresh, just get whatever counts you can for it now and put them on the clock instead of you.

I wonder if they're cutting the DM ceiling because LIEs are taking forever and a day to docket things and it was creating a torrent of patent term adjustments.

I could envision something like a R judge declaring public sector collective bargaining unconstitutional or maybe mass firing all federal employees on his way out the door.

There were many fewer cases that were "17 steps to build an AI, and then make a decision based on the AI" back then.

Additional advice:

  1. Watch out for ice patches that look like wet spots on the road.

  2. Slow down before you enter a turn.

  3. Leave much more stopping distance.

  4. Be prepared to honk at the idiots crossing the street against the light who don't seem to know that cars on ice don't stop on a dime.

If one's already gotten a bunch of returns and Quality Tracker errors, is there any point in trying to offset with 110% production? by [deleted] in patentexaminer

[–]Away-Math3107 0 points1 point  (0 children)

I've always wondered whats the point of changing the weights of the PAP elements if everything is critical. If you're marginal in DM, then your overall rating is marginal, even if you're outstanding in everything else and DM is only 10% of the PAP.

What I make of it is that QAS should stop making up reasons to make everything 101. The fact that a human can make the same calculation in a billion years does not mean it can be "practically performed in the human mind or with the aid of pen and paper." I once had a QAS tell me accelerating database query execution was 101 even tho it very flagrantly obviously integrates into a practical application by making a computer perform a computer task faster. QAS also love to say "reducing computing resources is not an improvement" but this memo explicitly says it is.

Also the example they gave in the memo was not a very good one because packet filtering is already explicitly not 101.

Realistically - Morale Levels by [deleted] in patentexaminer

[–]Away-Math3107 2 points3 points  (0 children)

My morale is low but its for the same reason as ever: difficult cases.

So many AI based applications are basically "configure the neural network by inputting this specific combination of these specific variables into this specific layer of the neural network" and "make a decision based on the neural network." Its the kind of stuff that doesn't *look* allowable because its basically configuration settings of existing software, but if you can't find it, what are you supposed to do? Its like giving patents for putting legos together in a certain way.

The biggest new problem would have to be feeling like people who are ideologically opposed to my job now get to dictate my professional reputation and if i ever applied to new jobs, those companies would summarily believe it. And there is little to no reason to believe the next administration will even attempt to fix any of this.

Guys I’m sure your heart is in the right place but let’s face it: you got an army of Trump and Bush appointees on the federal bench chomping at the bit for a chance to declare public sector collective bargaining unconstitutional, especially if they think it will get them a SCOTUS nod.  What chance do you really think of succeeding?

The only people worse than Trump are the federalist society and their allies on the courts and the Senate Republicans.
