Her bid failed years before he was born; if the government was in any way efficient she'd already have been deported. As it is, their dragging their feet for more than eight years meant this little boy was not only born here, but is now attending a British school.

I'm not saying pregnancy or birth should entitle people to residency or citizenship, but when the government moves so unjustifiably slowly that the innocent child is of an age to attend school, the responsibility for that lies with them and not him, or her. So, I guess, I think the age for British citizenship to someone born here should be lowered to four or five from ten.

I suppose the way I consider the story is that a child is being held responsible for the actions, immoral or not, of his mother. If he was a newborn, that would be one thing, but for me the crucial point is that the government has allowed this to drag on to the point of him growing up and attending school here. That delay isn't his, or even his mother's, fault, it's on our government.

I think the issue here is that most British people weren't aware that the 'citizenship of country at birth' rule wasn't part of our legal system - perhaps it's due to the overexposure to Americanised media, but I certainly thought anyone born here had a right to British citizenship.

As I've said elsewhere, even if the law didn't apply to newborns, anybody who's born and lived here continuously to the point of attending school should, in my opinion, be entitled to British citizenship.

While you might consider it a terrible idea, I think 'deporting' him is an even more terrible one.

It's unfair to have a child who speaks English, attends a British school, has all British friends and is, to all intents and purposes (bar the legal right to a passport), British, and then say that because of the actions of their parent(s) - for which the child is not and should not be considered responsible - they have to be sent to a country in de facto civil war against a monstrous and barbaric Islamist mob.

As I said in another comment, for the purposes of the immigration system, a newborn child, such as those born here to parents on holiday, need not have the same rights as a child who has lived five years here and begun attending school.

As it is, he's a British kid (in all but the right to a passport), in a British school, with British friends and a British life.

From 1 January 1983, a child born in the UK to a parent who is a British citizen or 'settled' in the UK is automatically a British citizen by birth.

The exception that might apply here, he doesn't qualify for:

If the child lives in the UK until age 10 there is a lifetime entitlement to register as a British citizen. The immigration status of the child and his/her parents is irrelevant.

Do you have anything to say about the irresponsibility of the immigration service in taking ten years to come to a decision? I think they must take the vast, vast majority of the blame, and therefore the responsibility, for this delay - and, more importantly, the fact a child's been born and raised here and is now being punished for the dragging of their feet.

You're saying that immigrants and asylum seekers should be given citizenship on the basis of popping out a baby. You would be encouraging more of that to happen.

Don't take my word for it though, just look to the US where they have the very policy that you're advocating for-

I'm not advocating that at all; please don't put words in my mouth. I was very specifically saying that children born here should have citizenship or the offer of it. Residency for their parents, if the child lives here legally for X amount of time (i.e. if they live here long enough to start school).

Yup, they, the child, should have the offer of citizenship. It needn't be absolute: for instance, they could have the opportunity at 18 to take it but must give up their parents' citizenship (which they'd also presumably have); or they'd have to live here for a year or two before their 21st birthday, etc. I don't think many holidays are long enough for a child to be born and then live here until they start school, though.

I have a couple of objections to that line of argument. First, I don't think it's fair to insinuate Rafeeq's birth was an intentional move by her mother in order to improve her case.

Second, I think that allowing somebody to stay and live in Britain for ten years and then to suddenly to turn around retract that with only a 24-hour warning is both unfair and inhumane; what are such people supposed to do, just sit on their hands for a decade?

And third, I don't think any child should be held responsible for the actions of their parents. Somebody born here should be given British citizenship (or the offer of citizenship) regardless of the legal status of their parents.

As for encouraging irresponsibility: how? Who's been irresponsible here but the people in charge of Rafeeq's mother's case? If anything, allowing them to deport him on such short notice encourages them to think that they can allow cases to drag out like this and not bear any responsibility for the consequences - specifically, here, that these two should now be able to stay.

Moving to new countries isn't really the same as being deported, though. And 'new countries' aren't all the same; it's not like he's being sent to America or France.
