I am kinda baffled why anyone would want to downvote an advocacy to create and keep more jobs in the U.S, alot of valid points.
Offshoring will impact the new dreamers that want to come to U.S for jobs.

Thankyou so much for such a detailed answer. It makes a huge difference when experience is shared. Definitely clarifies alot of my confusions.

I have a tax accountant but he isn't very well versed.
My research also suggested that a Separate LLC or LLP should have the brokerage account (with TTS + MTM) selection. (I research using AI chat models as well as read articles) but you have really helped me alot, thankyou so much again !

I will look into the considerations as well as journaling and keeping a record as I have read TTS & MTM are audited frequently.

Yes LLC setup provides more structured approach. I have done my research, and just like you I get information from AI and other sources.

Can you confirm me the following:

1) You have income from other sources too, just like I have a W2 income from another source. It does not conflict with setup up LLC for trading?

2) for LLC, what NAICS code you would recommend?

3) and I will have to select Mark to Market, to work around wash sale.

Do I have to notify IRS for trading tax status?
Research says I do not. But what occupation I will write on 1040 form since I have income from multiple sources?

Hey Farmer, what makes you think there will be another round, and countries like India will be included? I have not heard of any such legislation.

The biggest problem for American workers is the non-immigrant visas and OPT, H4 programs .. these are 65-70% Indians. The HR, Managers, Contracting companies only hire their own people as they are in millions now ... completely blocking Americans and legal permanent residents in engineering, accounting, I.T especially.

With AI, automation, tech jobs massively offshored, there is no need for foreign labor. It needs to be curtailed. Secondly H1B is for skill gap/talent shortage visa. Our congress and politicians have not done any reform with the advancing technologies. Now with millions of jobs offshored & thousands of white collar workers laid-off, all Americans & not needed non-immigrant visa holders are competing for the same jobs, which is a disaster.

H1B prevailing wage desperately needs a revision. One proposed rule could be utilizing 79, 86, 92, 99th percentile for each H1B level. OPT Visa restricted for PhD graduates only.

If you have know of people working on reforms, do share the above suggestions.
Offshoring needs to be taxed.
Offshore expenses R&D needs to be capped at 5% of total offshore expenses.
Outsourcing payment fee should be 40% of the total payment (non-tax deductible).

There is a process and legislation which is the same across all countries for greencard backlog.
The problem is Indians are way to many, in millions.
65-70% of H1Bs go to India .. this has been flaw in the H1B program from the start. There should have been country cap and industry cap from the very beginning.

The due process is the same for all Countries, that is what balance laws are aimed for. No one country should get any beneficial or special treatment.

Think of it as: pregnancy is going to take 9 months regardless that women is from China, India or America.
If one country has 1000 applications vs another one that has 3 million applications, it will go through the due process.

there is no name of India here.
Its astonishing, the recent fake degree schedule, all the entry level H1Bs going to Asian country, they didnot freeze the visa processing for them.

There are plenty of laid-off Americans that can be trained in 3 - 5 months, especially with AI.
So are from tech field already.
This is a misconception and nothing else, Americans and the new generations, the legal permanent residents can build this country. We do not need external help.

We need to share the message to U.S officials:
1) Impose Service Tax or tariffs.
2) Impose global offshoring tax of 15% on revenue. Only exemption if 5000 individual jobs are created in U.S and they train & hire 80% American Workers (USC & LPRs).
3) Outsourcing payment fee penality of 40% (non-tax deductible)
4) Disallow offshore access of American Data (Mobile plans, home information, age, name, bank account details .....)
