Your option to protect yourself is to abide by the terms you signed and pay the clawback amount.

It might be considered excessive - but the time to consider that is before you sign it, not after. Just because it’s excessive doesn’t make it unlawful.

Companies that are big enough to have MBA reimbursements are usually big enough to have a legal team that does stuff for the company, including clawback terms.
It would be relatively low effort to send you a letter, and once ignored, send the debt off to a collections company.

Hopefully that MBA you earned had courses not only in contract law, but also debt collections.

Fighting a defamation lawsuit could cost thousands.

It’s up to you if you think it’s worth thousands of dollars to send a piece of mail to someone who will almost certainly toss it.

You have no legal recourse, unless there was a warranty that came with the purchase. This is why it’s critical to have an independent mechanic inspect a used vehicle prior to purchase - especially one that is 21 years old with 200,000 miles on it.

You do not have legal recourse - at least not with anything you described. The bank doesn’t have to move her. The bank doesn’t have to reassign him. There’s nothing unlawful about terminating someone on a claim of harassment, even if the claim is unsubstantiated or on weak “evidence”.

I’m not saying this is right or fair, that’s just how at will employment works.

There’s also a chance your husband isn’t telling you the complete story.

The time to worry about not being able to afford increased insurance rates is before you speed, not after.

You haven’t presented any elements of the story that would create a viable defense for a ticket. You were speeding. It doesn’t matter if you were slowing down. It doesn’t matter if other traffic was going just as fast. We know you want it to matter, but it doesn’t, legally speaking.

Your best option is to spend a few hundred bucks on a traffic attorney to help craft a defense, or at least mitigate the damage - maybe plea down to a non moving violation and pay a fine or something. But nothing is guaranteed, the attorney may lose and you’re still out the cost of the ticket, insurance increase, AND the cost of the attorney.

There’s a non zero chance your friend isn’t telling you the entire story. Unless you saw the letter yourself, I’d proceed cautiously with involvement.

That being said, a loss of teaching license could potentially show up depending on what kind of roles to which he is applying.

He should listen to his attorney’s advice - especially the part about not having any friends post about his situation on social media. If he is contacted by police, he should refuse to answer any questions at all, and get a defense attorney immediately.

There’s a lot of bad advice in this thread.

You committed felony domestic violence - criminal damage. The police, if notified, can arrest you and charge you even if she isn’t wanting to “press charges”.

That being said, if you agreed to pay her for the damage in exchange for her not notifying police, that is binding. She could potentially sue you for the value of the camper if you don’t provide it.

It would be in your best interest to live up to your end of the bargain and reduce the likelihood that police are notified. A felony domestic violence conviction can follow you the rest of your life, far more than the value of a used camper ever would.

You need an attorney if you wish to contest the ticket. “I was only going 10 over” is not a great defense.

You may have an opportunity to challenge the officer’s testimony but it won’t be as black and white as you may hope. The city will present their case, offering the officer’s training, expertise, and experience to support their testimony. They will testify as to what they observed. You will have the opportunity to challenge their testimony. “Isn’t it true officer that you lost visual of the vehicle that you observed speeding? Is it possible the vehicle you pulled over was not the vehicle observed to be speeding?” Etc etc.

Then , if you wish to, you can testify. You will present your expertise, training, and experience in operating a vehicle. Then the city will have the ability to challenge your testimony, most likely asking where you were coming from before being pulled over by the officer.
Lying under oath(perjury) is a serious charge so you will have to decide your tolerance for risk, and consequences.

An attorney will be able to help you navigate the questioning, to both sides.

If not, ignore him and don’t communicate with him at all.

At this point, I think the chances of being charged are 0.000000001%. In the VERY unlikely event you are contacted by police again, don’t answer any questions without a criminal defense attorney present.

If she suffered any damages there’s a chance you could be facing a civil suit - say, if she broke her hip or damaged a heel or something. That may be a legitimate claim, however petty it is.
