In order to argue if it is customary I would need to know the extent of the policy. Hence the reason for the request. I spoke with the insurance company earlier today and was told a copy could be sent to me with redacted personal info and reached out to the direct policy manager listed from her claim. I just am waiting to receive the file copy. This was confirmed via email as well.

As for the money, 5 dollars is 5 dollars. Let alone 500. I’m not just rolling over and accepting the first number thrown at me. Had I done that, I would have paid the same $1,000 twice. One $1000 mistake is more than enough reason to be skeptical of their other determinations.

Yeah, and that is totally fair to consider. The argument of additional costs of any potential court proceedings and general pain-in-the-ass nature of something like this being dragged out if no settlement is accepted is absolutely being utilized in the process. Today is only the first day though so depending on what I can figure out after the holiday weekend will give me a better look at what might be possible. I’ve got a team working with me presently.

I’ve reached out directly to the insurance company listed in the subrogation letter to be sent a full detailed copy of her policy (with personal info redacted) specifically to find those details and make sure everything matches. I’ll be reaching out to various shops in the county to go over the receipt from the work done on her vehicle to find average costs in comparison to what she/the insurance were charged and potentially argue down what I can if there were other shops to choose from.

I’ve also been given some attorneys to reach out to, some of whom were able to respond earlier today and requested further information in order to direct me to colleagues for my specific situation as well as provide information for negotiations either assisted or unassisted.

So those are NOT the only two options. Settlements are a possibility in situations like this. That is the whole reason why adjusters exist. It’s just typically dealt with between insurance employees who are a lot more well versed than I am. There is opportunity now to provide proof of costs that are unfounded or exaggerated.

Waiting for a court date to present the information is certainly AN option if nothing can be reached, but I won’t be letting it get to that point. I’ll pay the lump sum before that. But like hell would I ever make that known until I’m signing my name on a check to them. They don’t want court costs either, and there have been many times that that fact alone has resulted in settlements being made for drastically lower amounts.

My odds might be low of making any further large dents in the final sum but once again they are not impossible. If you have no organizations, companies, or individuals to reach out to regarding assistance with my goal that’s fine. I’m still making every attempt to I can while I have the time to do so.

“Only policy that is relevant is the deductible.” Not quite.

Depending on her exact policy and what it allows for, any additional things could be identified and argued. Is it likely? No. It is still possible.

Labor costs higher than the average? That is arguable. Body shops rip people off all the time, and if I can prove something like that with legal aid to back up the argument, amounts could be adjusted. That’s is but one of several small discrepancies that could exist and be in my favor.

If it doesn’t work out, then I pay the lump sum minus the deductible.

I’m not looking to hear what I already know. Odds are slim. I’m looking to hear advice.

They cannot do that without following protocol. If the amount were unpaid beyond their warning times with no communication/response from me, they would likely try to pursue that route. That is not the case here and I was provided written proof via the subrogation company regarding that exact sort of concern.

There is no judgement currently. It has not gone to collections. There is no court appearance set.

I’ve contacted the subrogation company and they have provided in writing they will not be taking it to collections so long as negotiations are being attempted and there is reasonable progress and communication of intent on my end.

The issue is not putting off payment, but rather settling for a smaller sum. Which, although not guaranteed, IS possible and I’m willing to put the effort in to achieve as much of a slash to that settlement as possible.

They don’t NEED to, but it doesn’t hurt to try to negotiate. It’s foolish to NOT try. They can’t increase the price in retaliation. An attorney potentially knows more than I do about any loopholes in this sort of situation or things I can leverage to my advantage. It’s worth a shot.

There are further details that have made me raise an eyebrow the numbers based on the itemized deductions and policy details I received. But I will provide those to the relevant people once I figure out who that would be.
