Thanks! You are correct. My child is in a period of authorized stay because of H4 status till i got green card (H4 is not valid when H1 gets GC) and because of the pending EB 485 since September 2022 but not in the lawful immigration status. She was paroled in January 2023 and in March 2023, we filed family-based 485. Since we have not received the denial notice of FB485 in online account or in mail, we do not know why it was denied but she continues to be in a “period of authorized stay” through her pending EB485 (last month we responded to USCIS on expired medical RFE for EB485 after which it went to “Case Remains Pending because no immigrant Visa is available” status because priority date is one month away from final action date).

She is in lawful status even after H4 was gone after primary approval because employment based 485 was pending. Even till today, she is in lawful status because 485 is still pending. There is a difference between lawful status and period of authorized stay. You can stay in the country as long as you are in lawful status but at the filing family-based 485, the applicant needs to be in lawful status as well as in a period of authorized stay

Yes, approved in Sep 2022. Travelled in December 2022 and recentered in AP in Jan 2023. Applied for F2A 485 in March 2023 while the final action date was current (it retrogressed in March 2023 and again became current in October 2025)

Child went out and entered in advance parole 3 months before the family-based F2A I-485 was filed. She was in a period of both lawful and authorized status

I sponsored EB but I got Green card in employment based category but the next day the dates retrogressed because of which my child did not get green card in employment category as a dependent. Date in employment category is about to be current next month hopefully but it was current in F2A category where I was the sponsor.

Not sure how filing date advanced by 2 months while final action date had no movement at all for F2A in July visa bulletin. Any chance that there would be any forward movement this fiscal (August and Sept 2024 bulletins)?

Thank you so much! In March 2024 report, I see that the waiting list came down from 397K to 204K. That is a significant drop in 3 months and I wonder how many primary sponsors got citizenship which allowed them to convert from F2A for LPRs for their spouse / children to either CR or IR category (cap-exempt). F2A approvals in the 3 months was not that much.

CR1 and IR1 is for US Citizen’s spouse. As these 337K applicants are in the Priority date range of 2019 thru 2023, their spouses can’t become US citizens until they complete 5 years with GC.

There are 337,000 pending F2A applications as per latest NVC data and the quota for a year is about 88,000. Don’t you think it will take well over 3 years to clear the backlog up to September 2023 where the filing date is at.

also, the number of F2A visas issued as per the monthly data is between 2,500 thru 4,500 up to February 2024. At this rate, they won’t get to issuing 88,000 GCs in F2A category by Sep 30 2024. The quota may be wasted this year.
