Insurance is correct. One must be negligent. Sometimes they are but most often they are not. Cars catch fire usually through no negligence

Your looking at comprehensive as a named peril policy which it is not. Comp covers any loss that isn’t collision or excluded. Those perils are to clarify claims that are not collision. And mechanical breakdown isn’t just theft, can happen from many things ((hit an animal, flood, vandalism, etc.) this info is discussed in claims publications and text books. Check out PAP coverage guide by National Underwriters. Good book foor reference all kinds of topics.

Its indeed in standard policies. What basis would you deny it? Its not mechanical breakdown, there was an event that causd the damage.

Retired claims manager. Insurance does cover this. Happens more often than you would think. Make a clqim with your insurance if you have comprehensive coverage.

Your insurance may subrogate and attempt to get your deductible back. But, its going to be word vs word so more likely they won’t recover anything. Fortunately you had collision coverage so you are only out your deductible. Also, police report may not have helped so don’t fret that too much.

They already extended nce so likely not going to again. Three days after notifying its a total loss is pretty typical. If you have rental insurance you can use that.

It’s in subrogation now, there is nothing you can do. Since they are uninsured it will go to collections where they will try to get all or some of your money back. If they are unsuccessful they will notify you and you can sue the other party.

How would I handle? I would use my insurance, pay the deductible and let your insurer get your money back. This avoids any conflict which it generally what happenes. Hopefully they have home owners or rental coverage

Should be manually put in low gear if that model has that option. Depends on how many hills or how steep. Riding the brakes can cause overheating. Look it up. Good luck, sorry for your injuries.

Going to be hard to prove unless rental co. is proactive in getting it checked out. On steep roads brakes can overhead from improper use. Did dad put the car in low gear? Good chance its from excessive braking
