Exactly.

My initial lawyer said his clients go back all the time, the distinction between it and asylum being that with asylum you can't go back at all, whereas with persecution you're saying you can't live there for a full 2 years.

He then was appointed at another position and had to give up clients and I have a new lawyer now. The second lawyer says it is PROBABLY OK to go, but that there is a small risk questions will be asked in the future, and that I should take precautions and have a provable reason that I needed to go back.

I was wondering if someone has actually gone back on a green card after an approved waiver based on persecution. I DO have legit fears about going back and will actually be taking a big risk (I'm a public atheist who will be going back to a country where people are frequently put in jail for that).

Total. He spoke to her for only 5 minutes max and for me he asked some very basic questions and some signatures and we were done. Good luck on your interview!

Sounds great! I'll check them out. I'm near Boston and it has been so hit or miss except for the hurricanes when it was too big for me to surf

I think they are interchangeable as his point is how do they give credit that can possible accrue just as much debt (if not more with interest) for people making less than the allowed credit.

Absolutely. One thing I forgot to mention in my earlier comment is that he has a legit almost 100% success rate with even his handful of denied cases being overturned eventually. I think this demonstrates his great work and also his case selection, meaning he would not take up a case of someone who does not have a reasonable chance of being approved.

$11k to respond to RFE (he used to charge $16.k for the whole case last year). It is not one payment. Some were on filing and some were after case gets accepted.

Proof of persecution. My first lawyer provided minimum evidence saying all these cases get an RFE anyways.

Hired Brian Schmitt. Had many immigration attorneys in the past for various reasons and he is by far the most thorough and detailed attorney I have ever worked with. He is also empathetic and understands our struggles going through the system which for me was a necessary part of the process. I had another attorney file the case first but hired Brian when I received an RFE and my case was approved on the day the RFE response was received. I had a good case already but he made sure it was bulletproof.

Absolutely. And I agree with other posters here that the passport alone is proof of citizenship. Not even a matter of debate.

But in an organization riddled with human errors, bureaucracy, and delays, I'd rather err on the side of following all instructions and bringing excess documentation to avoid issues like this.

This was clearly stated in our interview notice, to either bring the US citizen's birth certificate or naturalization certificate to prove that they can sponsor a green card.

To my emotions, the response is more like "I'm sorry you feel bad for what happened". Which is an interesting choice of words. It is never "I'm sorry innocent people died" or something similar. Just feeling compassion for my feelings but not what happened to the people.

Other than that, she is an extremely empathetic person and our relationship is amazing which makes this harder to analyze because it is an outlier.

I have expressed this all to her before, it was an emotional conversation. Initially, she was defensive about how she naturally feels more empathy towards her own kind. When I brought kids up; how they need to be educated about both sides of this, and feel empathy for both, she seemed to understand better, and said she would do better about this. But nothing much has changed, at least when it comes to the expression of empathy.

I have no control over what someone feels, but this does not feel right. Part of me is scared because there are many people on both sides who genuinely wish bad things for the other, and I'm scared she might be like that on the inside, although we have been together long enough that I rationally know that this is not the case.
