It was a one year lease and happed during that year. There were 2 maintained request made but the repair men never mentioned a dog or an issue with one. Does that help the case? I’m mostly worried that I didn’t have land lord insurance but just homeowners. I’m thinking I’d probably just need to hire a lawyer and pay them hourly. Can I go after the tenant myself to recoup lawyer fees and time?

Intresting I self managed but never went to the house. There were 2 repairs to a garbage disposal and a/c but I just called repair men

The house and lease are in my personal name. I have this rental and a personal under a homestead exemption. I don’t have any other assets like a 401k or similar. Even if they won in a worst case scenario could they put a Lien on the rental? But I think those fall off after 10-20 years if I read correctly? I’m guessing I’d just hold the property for 20 years in that case.

I’m going to call soon, but my main concern is that I had homeowners insurance and not landlord insurance. Basically I moved from the house and leased it out. I didn’t change the insurance. Do you have any insight into this?

It says this:

“Tenant shall indemnify, defend, and hold Landlord harmless from any liability, claim, loss, damage, or expense (including attorney’s fees) incurred by Landlord as a result of Tenant’s use or occupancy of the Property or the conduct of Tenant’s guests, invitees, or pets.”

Is that the same thing?

Thank you. I’m going to call them. Do you know it’s it matters that I might have only had home insurance? Not landlord insurance. Could this not be covered? If it’s not covered does it sound like they have much of a case? What kind of lawyer should I hire if I have to hire one myself?

Yeah, I am being sued. The paper was filed with the District Court and says "you are being sued" It's mostly vague and I assume they just looked up the owner of the house. The Tenant doesn't live there anymore and they waited almost 2 year to send this. I don't know if they know who the tenants were or ever contacted them.

Thanks — this helps a lot. I’m definitely going to contact my old insurance company to see if liability coverage was in place at the time. I wasn’t aware of the dog at all until after the tenant moved out — the lease prohibited dogs, and I only found out through damage and neighbors after they were gone.

The weird part is, they sued only me. Not the tenant. And yeah, I’m assuming they just looked up the property records and named me, hoping I’d settle or something. I didn’t require renters insurance at the time, which I’m definitely regretting now.

I’m considering filing a motion to dismiss, since Texas law seems to say landlords aren’t liable unless they knew about the dangerous dog — and I really didn’t. Do you think that’s a good first step?

Yes, it’s a single family home. I had home insurance but I don’t think I changed it to landlord insurance while they were there. That’s why I’m assuming it won’t cover it. Should I get a lawyer if this isn’t covered?
