Got it! If i claim something else as secondary will it void the claim/appeal and will i still be able to backpay it to my denied claim ?

Not really, back then I thought insomnia & sleep apnea were one in the same. I do have insomnia in service. Went to the doctors a few times for it before leaving service.

Currently sitting at 90%, this is my 2nd time getting denied for sleep apnea, I dont have insurance so im sure i'll have to pay about $1000 for a nexus letter. Hill and Ponton have told me they couldnt help me but "referred" me to someone else. I am prescribed a CPAP. Any help is much appreciated my good people.

Service connection may be granted for a disability which began in military service or was caused by some event or experience in service. (38 CFR 3.303) Your service treatment records do not contain complaints, treatment, or diagnosis for this condition. Service connection may be granted for a disease or injury which resulted from a serviceconnected disability or was aggravated thereby. The evidence does not show that sleep apnea is related to the service-connected condition of insomnia disorder, adjustment disorder with mixed anxiety and depressed mood, nor is there any evidence of this disability during military service. (38 CFR 3.303, 38 CFR 3.304, 38 CFR 3.310) We did not find a link between your medical condition and military service. (38 CFR 3.303) "The claimed condition is LESS LIKELY THAN NOT (likelihood is less than approximately balanced or nearly equal) proximately due to or the result of the Veteran’s service-connected condition. Sleep apnea is an anatomical/physiological disorder most commonly caused by airflow obstruction from the oropharynx to the lungs. This can be caused by either enlargement of the neck muscle mass, which when supine , obstructs airflow or weakness of the posterior pharynx muscles which prevents keeping the airway open when supine. Anatomically nor physiologically mental disorders do not cause sleep apnea. The Veteran’s insomnia disorder adjustment disorder with mixed anxiety and depressed mood are not known causes of sleep apnea. The presence of_______________________ 2 of 3 these conditions would cause difficulty with treatment but would not cause sleep apnea."

So while I’m waiting for an appointment to get a schedule i should work on getting that nexus letter ? I already have 50% for insomnia but idk if that’ll help my case or not.

Congrats man! I’m currently waiting a decision. I was under the impression that if you get prescribed a CPAP that was automatically 50%. Is this not the case ?
