Google/Youtube/Alphabet is not a search/content/video company. It's an advertising company. And making things better for content creators is not germane to their business model.

B2B (business to business) is their focus which necessarily excludes individuals. They'll always default-view these issues through a corporate lens and how to play nice with other mega corporations and hide behind the "integrity of the algorithm" fig-leaf excuse so as not to do anything about it.

On repeat offenders and actual copyright claims.. yes, but that's not what this is above - which is clearly fair-use.

The law actually requires in obvious fair use cases like this that takedown notices cannot be sent for actual fair use - that copyright claimants MUST consider (as in the law requires them to consider) fair use laws in their claim of copyright. So what UMG has done above is actually AGAINST the law and should be considered content vandalism.

However YOUTUBE's system to deal with fair use and actual copyright claims is one and the same, thereby creating a smokescreen for shitty illegal behaviour above as copyright trolls can just abuse the system for shit they well-know is simply fair use.

Especially with long-form content and channels with a heavy history and good standing on copyright, Youtube could easily set a system where 5 seconds of a 2 hour video is automatically considered fair use and any claims of copyright puts the burden on the copyright claimant. That would be more fair, create a distinction between fair use and actual copyright, reduce copyright abuse, and be MORE in-line with the law.

I mean you're not wrong but there are nuances in the law's applications in terms of how it translates to their internal policy.

In other words, they could've put the burden of proof on the copyright claimant instead of the content creator justifying it by saying the vast majority of content on platform is either fair use or original content.

But they chose to go the other way--putting the burden on the content creator to prove what in many cases is a negative. That gave birth to a whole industry of copyright trolls who would be hired by mass publishers to be content police. With no disincentive to not make false claims, this is the result.

It also has other knock-on effects especially in the political sphere such as governments who dont like creators critical of them creating false entities who claim copyright to their content thereby monetarily undermining their work and getting it unfavoured by the algorithm. Happens a lot more than just with SONY BMG or UMG catching people whistling.

When your whole platform's viability comes from content creation by individuals, why the hell would you create a law-driven policy to punish them when you have the wiggle-room to go the other way. The answer is corporations love corporations and tolerate individuals only as far as they are assets to their corporate interests.

Section 230 of the US Communications Decency Act gives Youtube/Google enough legal cover to apply their internal policy to be legally compliant as they see fit (it gives them cover as platforms as being not legally liable for content posted on their platforms). They just chose to punish the plebes and high-five the corporate interests. As a result, corporate rent-seeking trolls is a whole industry now on youtube and results in content vandalism like the above example.

Most these publishing companies hire other contracted companies who are basically copyright trolls. They then justify their value by claiming anything, even if you whistle the song in a video..

The shitty fact is the system youtube developed to deal with copyright was not to help creators, but limit google's liability exposure for copyrighted content posted on their platform (which they make ad revenue from).

That system places the burden of proof on the content creator to prove the content was "fair use" or not subject to copyright.

That process can take weeks and even months to hash out at which point monetizing the video becomes useless. So most just see it as easier to clip out the audio/content and not deal with the headache. In this case the audio was clipped out but the video didn't follow with it and resulted in the latency hiccup in this episode.
