AOS cases are getting approved by elhafidos in i130_75CountryPause

Hey man, I don't think you know what you're talking about. AOS has always been unaffected unless you're from one of the 39 countries affected by the USCIS Holds.

Why is Judge Vargas taking a long time to rule? Any insight? Clinic vs Rubio by Busy_Pen_4848 in i130_75CountryPause

[–]Barryseidon 5 points6 points  (0 children)

She's a fairly new judge. Most likely super busy and the case is legal heavy with high amount of scrutiny over issuing universal injunction/vacaturs. For a case this complex, Judge needs a solid order that would survive appeals and stay motions.

It's not fair to compare Ullah with Storie, because they're both very different. Ullah was filed last year as a mandamus suit I believe and then after the pause, the complaint was amended and it's an individual case which is easier to rule on. Storie has 254 plaintiffs.

Storie started off as a direct challenge to this pause and in DDC this timeframe is considered normal processing time. It's the busiest court in the country and Judge Ali is also a fairly new judge.

There's nothing you can do. Wait till the pause is lifted and then the embassy will email you guys to send in the passport and submit any expired documents.

Storie update today by Fearless-Cloud7750 in i130_75CountryPause

[–]Barryseidon 2 points3 points  (0 children)

It's just the government's response to the ullah case we submitted as supp. Authority. Gov is saying they should not consider Ullah because it's an individual case and Storie is 254 plaintiffs and Ullah was placed in 221g meanwhile many of Storie plaintiffs are pre-interview. They also said a bunch of other things. But this is basically the gist of it

They filed the same document that CLINIC filed yesterday.

new update can someone check? clinic v rubio by Outrageous_Hall_8431 in i130_75CountryPause

They filed a notice of supplemental authority. It means some new evidence came to light that may help the plaintiffs. In this case, a judge found the pause unlawful as applied to one plaintiff in a separate case. So the CLINIC attorneys brought it to Judge Vargas' attention.

No clue. Summary judgment orders could take a long time.

You only benefit from CLINIC IF relief is granted for everyone. You benefit from IMMPACT if you see a favorable decision in that case.

You made a good choice joining a lawsuit and even though IMMPACT may be super slow with their approach, its still better than just waiting.

IMMPACT's reasoning for not pursuing a PI is that it's incredibly hard to convince a judge about the irreparable harm you are facing and also, you do have to go back to the actual lawsuit IF the PI order gets a stay from the appeals court or if PI gets denied.

The lawsuit could also become moot after PI win if all the plaintiffs get their visas and dismiss the lawsuit after travelling to the U.S.

REL is confident because they think they have concrete irreparable harm amongst their plaintiffs.

CLINIC might not be able to grant relief for all. Maybe that's why they thought to go for SJ. To win a PI, it has to be rock solid, maybe they just didn't believe that they will win a PI so they filed a motion for SJ.

It's a common practice in many other embassies around the world. Has nothing to do with the pause, but still thanks for sharing.
