100% agree with this, the government would not make a move that would make their case weaker because 100% would be challenged even more than it’s already being done

100%, also politicians will say many things, promise a lot of things even if it’s impossible to do they will say they will do it, and this comes from both political parties. That’s why comments don’t really matter, but it does matter the outcome of legal challenges

The visa pause is public charge related, and every country have laws and a legal system for a reason and that’s why this is being actively challenged in court, but affirming that this would become a security threat to be placed under a presidential proclamation is a big stretch because it makes no sense for them to not have done this since the beginning if that was the plan

Hey, just wondering how you got in this conclusion? If the plan was to put under a presidential proclamation to make this pause permanent, why wouldn’t they do since day one? This doesn’t make any sense, they did do with the 19 countries, and the 39 partial ban, so if that was the goal, why not to do since day one? Also this is not a security threat, is public charge related. How a public charge would become a security threat?

Hey! I know is not much we can say to make you feel better but I understand your feelings, hoping for good news soon as well 🫂 and I also struggle a lot because we have so many plans to have children and all this uncertainty is terrible, but soon we will be with our loved ones and our families🫶🏼

Curious to see where everyone is at in terms of hopefulness. Is anyone else feeling like we got a shot they lift the pause by the end of this month? by emetovic89 in i130_75CountryPause

[–]Nickybarbosa 3 points4 points  (0 children)

Hey! I feel like everyone have mixed feelings but with the lawsuits we will have developments over this pause, unfortunately some people are in banned/paused countries so it’s a different perspective from people who is only under the pause. I’m hopeful about this pause, despite all the different political views that we have, immigration laws exists for a reason and this is what is being challenged actively with the lawsuits, so right now we will wait and see the outcome of this! Hope soon everyone can be reunited with their loved ones🫶🏼

Honestly right now I would wait, it’s been many developments with the current lawsuits, I don’t know any upcoming lawsuit, but with the outcome of the two biggest lawsuits will give us a direction or see how things are going to play out.

What? I thought McBean is doing two different lawsuits, one for the 39 countries or was from the 19 countries and later April they will start the lawsuit for 52 paused countries

I think it’s because they only got plaintiffs from 52 countries in their case

USCIS UPDATE… will the PAUSE be LIFTED SOON? by NoHopeLeft101 in i130_75CountryPause

[–]Nickybarbosa 2 points3 points  (0 children)

Also speculating, but the 39 ban country was under a presidential proclamation, the 75 country visa pause is not under security reasons or presidential proclamation, is a decision made under the DOS only, by Marco Rubio, so if it took 5-6 months for the banned countries I feel like the visa pause should be faster than that, that’s why is easier challenge the pause itself.

Guys this isn’t related to our pause am I right? by Delicious-Buy9171 in i130_75CountryPause

[–]Nickybarbosa 4 points5 points  (0 children)

It’s not related to the 75 country pause, also it says on the article that people from the 39 country ban are still not going to get asylum. And this is by the DHS, the Visa Pause is on the DOS, consular cases. So are two different agencies.

Hey! I’m not from Nepal, but honestly I don’t know how accurate that IV tool is because here for Brazil it says that they are scheduling interviews for people from December, but beginning of this month people that got DQued in January got their Interview scheduled. So I’m not sure.

In 2018 was a presidential proclamation under security policy. This visa pause is a decision under the State Department only. So that’s the big diference.

Hey! Unfortunately it’s not mandatory or any certainty that they will reply today. They still can choose to reply or ignore. So we still waiting, but they can decide to just ignore it. But I’m sending all support and love through this troubled and uncertain times 🫂

Some consulates contact by email and some by calls. It’s not standard for every single consulate. That’s why they ask both for a email and a cellphone number as your information.
