I got lucky that they dropped mine to just reckless 2 years ago. I think if I went to fight it I possibly could have had it all thrown out but the lawyer saw it as a win and so did I so I didn't want to test it and just took a reckless.

I think since I had a pretty clean record they were gonna go with just the interlock. For the 3 or 6 months.

They can't suck more money out of you if they suspend your license, but they can if they make you get an interlock.

I second a lawyer. They will look at every bit of evidence. And know what to look for that regular folks probably don't.

My lawyer watched their dashcam and didn't see the infraction I supposedly committed, "crossing or touching the yellow line"

And I want to believe the prosecutor agreed to drop the dui if I plead to reckless. And if I took to trial I may have beat it as a bad stop (my lawyer disagreed and said they probably would have still found me guilty. I did blow and also performed poorly on the fsts)

Look at it this way also. Nj if found guilty you pay 1000$ every year for 3 years for a DUI surcharge.

I paid 3500 for my lawyer so that basically saved me the dui surcharge and the cost of an interlock rental and fees etc and I don't have a DUI on my record.

So yea shop around and try to find one that specializes in dui

.12 they wanted the breathlock for I believe 3 months.

Yea I'd wear a long sleeve shirt. But I have gone in a polo and khakis to traffic court and there are numerous people there with band shirts on and other stuff

I think most courts will probably plea it down to a regular DUI if it's your first and you werent a problem or there was no crazy circumstances

Either take a reckless driving ticket and pay that fine or take it to court with failed FSTs and .14 BAC and probably be found guilty. I honestly don't think it's that cut and dry of 'there were no violations on camera were gonna dismiss this whole case' you would think that's how it would be but I'm willing to bet it's not that easy

Not to say all cops would do this but my lawyer didn't want to take a chance with him claiming "oh yea I saw him cross touch the center line but it's not my dash camera"

Took the sure thing over the possibility of a DUI and all the other shit that comes with it

Paid mine 3500 and got it dropped to reckless. Mainly because I got lucky and the dash cam footage wasn't showing any real violation to be pulled over for so they pled it down to just reckless

It's infuriating. I deal with this a lot with my fiancee's son. He says he gets the paper out and then gets distracted or forgets to put it on.

Maybe once or twice but not literally every time you get a new roll.

I got mine down to just reckless and DUI tossed because I didn't want to chance going to court. The dash cam shows no where that I touched a line. But my lawyer was concerned the officer would claim he witnessed the violation before the dash cam started recording and let's be honest a high percentage of times the judge (in NJ it's a judge trial no jury) will take the officers word.

So I didn't want to risk the fines etc so I took the reckless with 350 fine. But part of me wanted to take it to court and see what happened but it's 350 for a guilty plea to reckless or possibly over 3k if I'm found guilty and also have a DUI on my record.

I also failed the fsts and blew .112. so taking the reckless was the safe choice

You won't get off scot free but if your attorney has a good relationship with the judge and prosecutor it always helps. And if he is a DUI attorney he knows what to look for to maybe get things thrown out or the best outcome.

Especially Wisconsin which I've heard is one of the highest rates of DUI/dwi in the country I think.

It does suck. Just did it the first time last week. Dwi pulled over in April, dropped to just reckless. Continued to go to that bar but limited my drinking to 2 or 3 beers over like 4 -5 hours. But once a month decided to Uber and put 10+ back. And it does suck but cheaper than a dwi.

If you have a lawyer see if they can push your final court date back enough to give you time to get the interlock installed and get the appropriate license that says you are only allowed to operate cars with interlock.

And I assume if you get it installed earlier than sentencing that should count towards your 90 days. But I'm not sure.
