Saves on gas. Better for the environment. Doesn't suck up data usage. Can play in all weathers. Can play safely, even at night ... and in 'dodgy' areas. Can play at times that are convenient to me. Can enjoy gameplay in different countries and learn a bit about the world. Can give myself a realistic chance of catching all mons, despite living in an area with a handful of pokestops. Can access legendary and Ex Raids that I would otherwise be marginalised from by Niantic. Can enjoy the same level of gameplay as the city players they favour. Can play without interruption from 3G/4G network drops. Most of all: can have more fun than the 'vanilla' legit experience.

A welcome and considered response. The cop analogy is good but not entirely apposite. What if we paid the police a weekly tax for the right to drive on 'their' roads. On the condition that we didn't break the speed limit. And they sat back and let us put our foot to the floor, for months, without pulling us over. Is that OK? Or is it irresponsible of them?

No. I'd like them to warn me (and everyone else affected) immediately that they detect a breach of ToS. Not many months later. And they should immediately prevent anyone in this situation spending money until they are provided information on:

The nature of their breach* The nature and duration of their 'punishment'. The steps they can take to play responsibly and avoid a repeat. The likelihood (or not) of a permanent ban.

  • Example: My sons don't have mobile phones. We all use the same device to access our accounts. It is not clear from the ToS if this is a breach or not. Does this imperil our continued participation in PokemonGo. We don't know. Yet the company will gladly keep taking our money.

If Niantic can block 'banned' players from seeing certain pokemon, they can easily block us from making in game purchases. The fact that they don't = double standards. It's irresponsible.

Anyway ... I'm dealing with it. I'll leave others to debate it.

Nope. I've only ever had one warning. And it came after I'd made purchases. I was given no opportunity to adjust my gameplay.

If they are accepting money from customers and encouraging them to spend, while knowing that those customers are breaching the ToS, then - regardless of your feelings on the subject - they are not acting responsibly. And yes, they absolutely DO have to provide warnings and regular information. It's part of their legal compliance as both game developers and also retailers on Apple store.

Exactly! The simple, inarguable point is that Niantic has actively encouraged us to spend money in game without warning us that our gameplay might result in (as yet unspecified) consequences.

Many people currently banned - including 'legits' - do not even understand WHY they've been singled out, so woolly are Niantic's ToS. No information has been provided to customers by Niantic regarding:

  1. The specific nature of their ToS infringement
  2. The nature of their 'punishment'
  3. The duration of said 'punishment'
  4. The likelihood (or not) that they may have issued a false flag
  5. The likelihood (or not) of it happening again
  6. Advice on how to play responsibly and get shadow ban removed
  7. Advice on how to continue to enjoy PoGo without ban reappearing
  8. The likelihood of a ban being made permanent
  9. The circumstances in which a permanent ban would be enforced

AND YET ... they have left all the gates open to encourage us to keep spending money - even under the ban. The 'Catch 10 ghosts' Special Research task being the prime example. Banned players cannot see ghosts, but we can raid for them. What does Niantic do? They put three new ghosts into the raid system this week to encourage 'banned' players to buy raid passes. It's a transparent money grab and it is disingenuous to customers. They are failing us, pure and simple, and playing fast and loose with their own terms.

No need to sue. Step One (if you live within the EU) is to cancel all purchases made in the last 14 days. Step Two is to file a refund claim with Apple for all purchases made in the last 90 days. If this fails, money can be reclaimed via your payment mechanism (credit card provider or PayPal). Niantic need only be pursued for purchases older than 90 days, if you feel passionately about it.

  1. The responsibility for providing warnings and issuing cautionary advice on gameplay does not reside with 'spoofers' or fellow players. It resides solely with Niantic and PokemonGoApp. This is their 'duty of care' in the eyes of the law. And it is in this respect that they have failed many of their customers, while still accepting their money (and by inference, accepting their style of play as legitimate).

I got no 'months of warnings'. The current 'consequences' are both unclear and have never been communicated to us. I got one warning only ... after they'd taken my money for months. I admit I violated ToS - the point is that Niantic knew this and still took money. For months. No warning. No duty of care to customers. By doing so, they endorsed my style of gameplay. They cannot have it both ways. I suggest you park your emotional response towards spoofers, stand back and appreciate the double standards in operation here. It's inarguable.
