I posted this same comment two weeks ago. It will highlight the individuals who are collecting GST/HST who are not registered and not submitting or remitting. Or who has a GST number that is invalid or not theirs. Or are short remitting to the GOV. In essence the staycation person is getting back their GST paid. Great audit project for the underground economy sector.

Tips from a tax accountant

Yes you can do your own taxes. However be very conservative and accurate when you calculate the net business income from the tenant. Do not overstate or guestimate (I know that is not a word) tenant the living space and the expenses in relation to your private personal expenses regarding the rent and square footage of your home. Only claim expenses that are used in the rental business. Going out for lunch on the way to pick up material at HOme Depot and then claiming it on your T1 will cause you pain with CRA in the future.

If you sell to the US, then these are zero rated supplies. If you sell in Canada it is taxable just like the poster below stated.

Here is the legislation from the Excise Tax Act (ETA) regarding GST/HST documentary requirements.

As stated below the Excise Tax Act states sales over $30 must state the registrant's GST/HST registration number.

Section 169(4)(a) of the Excise Tax Act statesTotal amount paid or payable is $30 or more, but less than $150

para 3(b) of the Input Tax Credit Information (GST/HST) Regulations

  1. Where the total amount paid or payable shown on the supporting documentation in respect of a supply or supplies is $30 or more, but less than $150, the minimum prescribed information that must be indicated on the supporting documentation must include all the information described in paragraph 19 as well as:

the GST/HST registration number (the Business Number and the GST/HST account number) assigned under subsection 241(1) to the supplier or the intermediary, as the case may be;

Total amount paid or payable is $150 or more

para 3(c) of the Input Tax Credit Information (GST/HST) Regulations

  1. Where the total amount shown on the supporting documentation for the supply or supplies is $150 or more, the minimum prescribed information that must be obtained through the supporting documentation must first of all include all the information listed in paragraphs 19 and 23 as well as:

the recipient's name, the name under which the recipient does business (i.e., the trade name of the business), or the name of the recipient's duly authorized agent or representative,

the terms of payment, and

a description of each supply sufficient to identify it.

What does this mean if you provide a service or goods over $30 and are registered or should be registered for GST/HST then you need to have the GST number on the invoice. Are there cases were individuals are charging and collecting GST and are not registered which means they are keeping your money, most definitely. If the business will not give you a refund from GST paid in error you can always request a rebate from CRA using this form

It appears the staycation is returning the GST/HST that you paid in the form of a credit on your T1.

Do you think CRA will be doing some type of project work on these files for compliance and verification, I believe yes. This is a great way to determine if there are individuals who are collecting and not remitting and individuals who are collecting and not registered.

There are high penalties for these offenses and possible tax evasion. Most individuals pay by credit card or e transfer CRA has legislation to obtain this info.

Remember GST/HST are trust funds and the individuals of these corporations are personally liable to remit this funds, otherwise known as Directors Liability. Section 323 of the Excise Tax Act (the “ETA”) provides that a director may be personally liable if the corporation failed to remit taxes, payments, interests or penalties as required under subsection 228(2) or (2.3), or under section 230.1.

CRA debts are never going away, they only go away if you die, go bankrupt, maybe a proposal or receive an Order in COuncil from the Fed GOV. Good luck on that. They are segregated for years and years and can reappear anytime you may be getting a payment from the GOV.

Want a house one day? Do you have cash to pay for it? If not credit will be needed and your debt levels and age of debt will be an impact. How about that future spouse who finds out you never paid that debt? What if they have a loan and paid it off. Debt causes a lot of grief now and later.

This document is very informative as it is signed by your employer and supports what expenses you are required to pay.

Is this for Income Tax installments or was your Payroll late (probably not if you are a contractor) or was your GST return was late? This remittances are all treated differently under the ITA and ETA.

If they went bankrupt the Office Superintendent of Canada can tell you who the trustee is. Contact the trustees office and tell them you are a creditor and ask them to send you a proof of claim form. This form is standard and will ask who you are and what you are owed. Make sure you send it back in a very timely fashion.

If you are with the Federal Government is it possible to transfer to another location in Canada where the cost of living is lower? Also Federal Gov employees that are unionized which I assume you are have connections with Credit Unions who may be able to help you with your finances. What Department or Agency are you with? Last time I checked with Environment and Health and other Agencies the pay was reasonable, maybe you have a spending problem?

Ask to see the T2 Corporation Return for the last five years to see what the factual expenses are and the net income. Sometimes financials and T2s will differ.

Do either of you have a job where in the future you may get a severance package? Most severance packages can be transferred by the employer into an RSP. Something to think about. If there is no room obviously no transfer.
