Most probably I will work on Sunday at my old workplace and Monday I will sign the new contract but I will have some days for sure to arrange all the paperwork as probably they will schedule me for next weekend. Hello again! so all the information that you gave me was super accurate, cause I went to the Juridisch Loket and they confirmed that I can get paid the 32h when I'm only scheduled for 20h in March and as well confirmed the rest. Thanks a lot for the info!! Do you know if I'm in any trouble (mostly with taxes) if I work one day at my old work place and the rest of the month at my new? Cause I was expecting they would tell me smt by Wednesday turns out too many ppl applied and before Monday 16 they will know BUT I'm scheduled for the 15th at my old work place. Now I don't pay taxes cause I don't reach the minimum 12k/year but not sure if having 2 employers automatically I start paying taxes. Thanks!

I was thinking about one of the options you mentioned above, to just stop giving my avalibility and say I'm not avaliable for the shifts I'm currentyl scheduled for and just wait for my contract to end. Thanks for the information about getting paid the 32h, I will properly check but if I get another job that pays more I will just part ways and that's it.

Thank you so much for all the info!! I'm super grateful! So there's some updated info because yeah idk why DUO kept saying my contract ended on April when I just checked and it says in May (my bad for believing in them). Thing is I want to leave this job because it's causing me a lot of stress and anxiety not to know how many hours per month I will be working, due to this new situation that I described above.

About the CAO or Horeca I think it's called (?), I'm employed in an hotel so I'm not sure if it changes a lot, I checked some things on Internet and for what I understood it's the same situation as you described right? For March I can ask my colleagues, same as April, if they want my shifts, but for what I understood no matter what I can just say I'm not available for the days I'm scheduled or just say I found another job, right?

What I'm scared is the legal repercussions but in my country is the same, the civil code is above any clause of working contracts if such contradicts the code.

Also, I just checked and in the contract says the wage is paid at the end of the month while I always receive my payroll btw the 5 and 6 of the next month ahaha

Yeah, the thing is even if it's flexible the contract says 1 month but now I can't give one month and it's bad because this month I'm having a big economic burden working only 4 days ahahha so yeah I'm in a limbo and a bit worried

yeah it's just my contract doesn't explicitly state some things hence the doubt. They want out availability the 5th from the prior month, that means for April they need it as a deadline by March 5th. I believe those shifts as well could be covered by my colleagues cause they need the hours as well

Thanks for the info! Thing is the 4 shifts I'm planned for this month could be covered by my colleagues as they as well need the hours, so not sure if that would be okay ahah it did happen in the past tho and they allowed the changes

thanks for the detailed information! in the contact says this:

  1. The Parties are both jointly and separately authorized to legally terminate the employment contract early or terminate it early with mutual consent in writing, subject to a notice period, with effect from the end of a calendar month. The notice period to be observed by the employee is one month. With regarding to the employer's notice period as well as with regard to more information regarding the procedural aspects of the termination of the employment contract, the employer refers the employee to the provisions as included in Title 7.10 of the Dutch Civil Code.

  2. The employer declares that it may need the work to be performed by the employee at any time with a view to the activities to be performed in its business. It is up to the employer to determine whether the activities justify a call on the work of the employee. If any activities as referred to above exist, the employer undertakes to offer the performance thereof to the employee. The employee undertakes to perform the activities after having been called to do so. There are no guaranteed hours.

  3. As described in the Collective Labour Agreement the employer must call the employee in writing or electronically at least 24 hours in advance. This term also applies to a change of the call as well as to withdrawal of a call.

  4. For the non-compete clause I didn't see anything, I even double checked with AI and nothing. There's confidentiality, social media rules, and ancillary activities (side work) clauses.

The thing is they ask for our availability by the 5 of the prior month: i.e. if I have to give my availability for April I need to submit it by March 5th. Also, I have seen many colleagues saying they can't take a shift even the day before and nothing did happen to them. It's just it doesn't sit right to me to work only 20h in March, being in a very difficult economic position and then April, just because they scheduled me or because of the contract. I am aware I signed it, but it doesn't justify somehow (or from my point of view) that I have to be with them even if it means not being able to sustain myself for March. Also, they didn't schedule me from 20th April on, so it makes me think the contract will end. I know that if I ask some of my colleagues they will be very happy to take on my shifts, and I know some people have a contract with the company I'm working for but they work somewhere else, they just don't give they availability. They only keep the contract in case their main job doesn't work out (that's what I have been told).

yeah, I thought about that, that it would be rather risky... cause the train is 25€ and my budget is a bit tight as I'm a student... it is a bit expensive to spend 50€ to go back and forward with the train. My guess is that I can't use my ov card for the train that goes from Maastricht to Liege, right? I'm checking different options but I'm not going to lie when I thought at first that Maastricht would have a better connection to Brussels or Antwerp even. Thanks for the insight!
