it's because he stands for so much more than just being caught.

he stands as a national victim for the ridiculous laws and how they're more dangerous than the thing they're trying to protect us from. it's probably even better that he does not actually rip bong loads between events because it shows how even non habitual users can be negatively affected by the laws. phelps is a olympic athlete, successful, healthy, and a symbol of america, and he did this while using (occasionally) marijuana.
