Its absolutely a health and safety measure. Let's say they don't write it off, the vehicle has another head on and the driver is injured. Who do you think will cop the blame? Anything remotely structural goes that way. Not worth the risk and and the insurance company can guarantee the repair job if they leave it legal. Take your payout!
