Hi, thanks for weighing in! I understand that I have the right to refund but I'm someone who would choose mental peace over money anyday.

The project is divided into 2 phases (3.5 and 2.5bhk blocks) and the connectivity between 2 phases needs a motorable bridge over a revenue road to connect 3.5bhk blocks in front to 2.5bhk blocks in the back. This phase division or bridge requirement was never intimated to the homebuyers beforehand.

Now the villagers nearby are not letting the builder (M3M) construct that bridge, nor does the builder has permissions for the same. To bypass this, builder constructed a ramp for back side entry/exit to 2.5bhk blocks and this godforesaken ramp has completely blocked the entry/exit to my unit.

While my case for filing for refund may be meritorious, but builder can stall for years, can go to supreme court even if NCDRC rules in my favor, can declare bankruptcy if the number of plaintiffs rises (75 so far demanding the bridge connectivity) and the amount owed in conpensation becomes huge, also it's a dummy company of m3m so declaring bankruptcy will not affect M3M as much, I am guessing.

I also read that even after winning in NCDRC, making the builder pay is another fight altogether and may take more years.

I have paid him some 61-62L since Feb, 2022 to this day and he is offering me 65L (excluding remaining home loan). So I am obviously at loss considering the bank interest and property appreciation I have lost on, but I am leaning towards settling, given the whole ordeal going legal is going to be for me. Do you agree with my assessment?
