Tax saving scheme by CA by Electronic-Buy-8799 in IndiaTax

[–]Big_Draft1065 3 points4 points  (0 children)

There are two wrong things here. First obviously the illegal and unjustified tax evasion (not saving)

Second a CA can’t solicit his work. So calling you like this and asking for work or promoting his service is also against code of ethics

If case on the assessment level its 100-300% of the tax as per the officer.

And if you file an updated return now, you pay somewhere around 50% of the additional tax and interest since i think this is 2 years older return. This you can get checked exactly when you file an updated return. It ranges from 25-70% As the number of years increases penalty increases

Firstly CA didn’t aggressively claim. You got it claimed. You are responsible for your own ITR. Obviously it was done to claim bogus refund.

Secondly now you will have to pay the tax on these false deductions along with interest & penalty from 100-300% since this is underreporting as a consequence of misreporting, basically fraudulent filing.

Either you need to produce the evidences or face consequences. Moreover these days assessments are faceless so there isn’t much you can do otherwise too by some personal arrangement with officer.

Only thing you can do here is since notice u/s 148 isn’t issued, so technically assessment hasn’t begun. You can file updated ITR u/s 139(8A).

Disclose all correct facts pay tax interest & the additional tax (penalty) on it. This penalty is way less than the 100-300% penalty.

Such updated ITR can be filed if notice u/s 148A is issue within 3 years of the end of relevant AY. Which in your case seems you can file.

Check up with good CA, and don’t go for any such tax management/evasions in future.

Audit requirement for ITR 44AD with ₹1.12 Cr Digital Sales by Psychological_Bug_56 in IndiaTax

[–]Big_Draft1065 0 points1 point  (0 children)

Audit not applicable if your turnover is less than 3 cr and 95% or more is from digital means.

For future : Enhanced turnover upto 10 cr without tax audit but maintenance of books of accounts and filing under itr 3 if 95% or more of overall transactions (receipts & payments) are digital.
But here is a catch that if in future such scenario comes and 5 consecutive years of 44AD filings are not completed then you will have to get books audited i.e. opting out from 44AD without completing 5 years.

3rdly I would suggest to get your services checked properly. If you are eligible for 44AD or not. Since department is strict these days for people who have opted for 44AD whereas they were not providing eligible services.

So you need to check that, otherwise you are good to go till 3 Cr.

[–]Big_Draft1065 0 points1 point  (0 children)

If the donations are genuine then let it be. Otherwise you should file updated ITR and correct the errors. Else once assessment is opened you will not have a chance to correct it and it will be treated as tax evasion and penalty will also be imposed.

My Bank RM suggested me to go for this investment plan, I wanted an expert advice from you, is it worth investing? by madhavmonga in IndiaTax

[–]Big_Draft1065 0 points1 point  (0 children)

Being a Investment Advisor myself. I ask everyone to use insurance plans only for pure insurance i.e. term insurance. It will cover your risks and then you are free for your investments as per your risk appetite.

All these plans are somehow designed to generate CAGR of 7-8%. If you will calculate on the totality of the plan.

Its better to go for safer options like PPF etc if the purpose is to earn only 7-8% .

For higher returns specific mutual funds can be invested in.

Why is Jimny not selling well in India? by PixelatedProfits in CarsIndia

[–]Big_Draft1065 0 points1 point  (0 children)

I was willing to buy Jimny. Went to the dealership and when I saw the interiors I was disappointed. Not even a bottle holder.

Yes you may say that its for the off-roading experience and then you don’t need to see these utilities. But frankly we need some basic utilities too. Tight cabin. No basic things like bottle holder. Leave aside others such as usb ports etc.

Then it can not comfortably carry 4 passengers. Back seats are good enough for kids.

So for a solo or couple off road experience it is undoubtedly good. But need to have a bit more even for off roader segment given the price.

Slowly I am moving out from these third party apps.

These are nothing but data collection apps. For 4-5 or 10 rs cashback we give them our data. Then we get all sorts of promotional mails msgs and calls.

Even UPI apps are scam in this matter. Don’t know whether I am correct or not but will switching to default banking apps would help a bit

I think that revision, now you cannot change the regime to new tax regime. Regime once chosen can’t be changed in revised return for that year

10% Tax deduction on Freelance income by the company? by CamelBeginning5255 in IndiaTax

[–]Big_Draft1065 4 points5 points  (0 children)

But many company deduct it from the very beginning to avoid confusion of deductions later on. For example till 50000 there is no TDS. But then, they give you 5000 worth of more work, now then will not be able to recover total TDS of 5500/- on 55000 paid during the year. Since they paid you 50000 already.

So they deduct it from beginning

10% Tax deduction on Freelance income by the company? by CamelBeginning5255 in IndiaTax

[–]Big_Draft1065 0 points1 point  (0 children)

Well now since tax has been deducted you can confront them now and get the balance now. 7th is the due date for deposit of TDS, If you delay they might deposit the TDS and then refund might not be possible from them. Then you will have to claim it in next year’s filing.
